HomeMy WebLinkAboutResolution - 072530D - Street Improvements - City Engineer - Portions Of Avenue H - 07/25/1930o7zs3aD RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF AVENUE "H" IN THE CITY OF LUBBOCK, TEXAS, FIXING TIME AND PLACE FOR HEARING TO OWNERS OF ABUTTING PROPERTY, AND OTHERS INTERESTED, AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE. WHEREAS, the Governing Body of the City of Lubbock has heretofore ordered that a portion of Avenue."H11 be improved by raising, grading and filling and installing concrete curbs and gutters and paving with No.QAAy_1 2-1/2 Inch Vertical Fibre Brick Pavement on Four Inch Concrete Base, together with incidentals and appurtenances, and contract therefor was made and entered into with Panhandle Construction Company; and, WHEREAS, the Governing Body of the said City has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, such estimates have been examined: and approved. THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS: THAT, I. Such estimates be, and they are, hereby adopted II. It is hereby found and determined that the cost of improvements on such portion of Avenue "HIT, with the amount or amounts per front foot proposed to be assessed for such improve- ments against the abutting property and owners thereof, on such portion of Avenue "H", are as follows, to wit: On AVENUE "H", from its intersection with the North property line of Nineteenth Street to its inter- section with the North property line of Twenty-sixth Street, known and designated as Unit or District No. ; the estimated cost of the improvements, including storm sewers, is ,• the estimated cost of the improvements, exclusive of storm sewers, is ; the estimated amount per front foot to be assessed against abutting property and owners thereof for curb 9X&XgiC XX is ; the estimated amount per front foot to be assessed against abutting property and owners thereof for improvements exclusive of curb ZMAxgex is 4 ; total estimated amount per front foot to be assessed against abutting property and owners thereof is No part of the cost of storm sewers is included in the estimated amounts to be assessed against property owners. t O7Z�►3C�D III. A hearing be given and held by and before the Governing Body of the City of Lubbock, Texas, to all owning or claiming any property abutting upon any of said portion of Avenue "HIT, as well as all owning or claiming any interest in any such property. Such hearing shall be even and held on the �_ day of C�,,_< , 1930, at o'clock, M., in the in the tty of Lubbock, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing, and of other matters and facts, in accordance with the terms and provisions of the Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said LegislaturD, which has been adopted as an amendment to and made a part of the charter of the city of Lubbock, Texas. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Lubbock, Texas, the first publication to be made at least ten days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act. PASSED AND APPROVED This �J day of Ju 1y,, A. D. 1930. THE STATE OF TEXAS COUNTY OF LUBBOCK WHEREAS, Panhandle Construction Company has entered into contract with the City of Lubbock, in Lubbock County, Texas, dated the �iS%*_ day of Jalf, A. D. 1930, for the making and construction of ce tain street im- provements, consisting generally of raising, grading and filling, and installing concrete curbs and gutters, and paving, and otherwise improving a portion of Avenue "Hl' in the City of Lubbock, all as provided in the plans and specifications referred to in said contract; and, WHEREAS, by the terms of such contract and speci- fications, it was provided that the said Panhandle Construction Company should give to the City of Lubbock its bond, conditioned for the faithful performance thereof: THEREFORE, KNOW ALL TMEN BY THESE PRESENTS: That we, Panhandle Construction Company, as Principal, and as Surety, do acknowledge ourselves firmly held and bound to pay to the City of Lubbock, Texas, subcontractors, workmen, laborers mechanics and furnishers of materials, as their interest may appear, in the sum of _rw. 14rt. `f4aord d 0ic.4ao0 ,w� dict a DOLLARS -T., , to the payment of *,hich we do hereby bind ourselves, our successors and assigns. The condition of this obligation is such that, if the said Panhandle Construction Company shall truly and faith- fully perform all the obligations undertaken by it in the said contract and specifications therein referred to, and made a part thereof, and shall pay all subcontractors, workmen, mechanics, laborers, and furnishers of materials in connection therewith, then this obligation shall be void, otherwise to remain in full force and effect. This instrument does not guarantee the obligations contained in paragraph VIII of said contract. It is expressly agreed that changes in the plans and specifications, overpayments to contractor, or failure to mare prompt payments, either in whole or in part, shall not invalidate this obligation or release the surety thereon. It is further expressly understood that extensions of time for performance of the contract or any other forbear- ance on the part of the City of Lubbock shall not operate to release the liability of the surety hereon, and no notice from the City of Lubbock to the surety concerning any change, ex- tension or forbearance shall be necessary, but any and all such notice is hereby waived.
