HomeMy WebLinkAboutResolution - 052638D - COL Divided Into 3 Livestock Zones - 05/26/1938052(PBBD RESOLUTION BE IT RD21EIVIBERED, that at a regular meeting of the City Com- mission of the City of Lubbock, Texas, held in the city hall of said City on the 26th day of May, 1938, upon motion of Commissioner Fo rtenberry and second by Commissioner IIcMillan , the following Resolution was duly passed: WHEREAS, the City of Lubbock is an incorporated city and operating under a home Rule Charter as provided by the laws of the estate of Texas; and WHEREAS, said City has a population of 30,000 inhabitants within its incorporated limits; and uvHEREAS, there are now being kept within the corporate limits of said City some 1400 head of cows, 150 head of horses and mules, 100 goats and 50 sheep; and WHEREAS, there has been many complaints by resident citizens of the City of Lubbock to the City Commission, complaining about the unsanitary condition in many of the lots, yards and places where said livestock is kept, and other complaints made by many of the resident citizens of the City of Lubbock that the lowing of cows kept near their premises interrupts the quiet and peacable enjoyment of their homes and property; and WHEREAS, other resident citizens have made various complaints that the number of livestock now permitted to be kept within the city limits of the city of Lubbock have created an unsanitary condition and endangers the public health of the resident citizens of said city; and VVHEHEt-�S, many of the owners of said livestock that is kept within the city limits refute and deny the charge made by other citizens that their livestock create an unsanitary condition which endangers the public health of the inhabitants of the city of Lubbock, and further deny that said livestock interrupts and prevent the quiet and peacable enjoyment of any citizen in the city of Lubbock in his home and premises. Therefore, in view of the above facts the City Commission of the City of Lubbock has determined to divide the City of Lubbock into three Livestock Zones for the purpose of permitting the inhabitants in each zone to vote upon the question as to whether or not livestock, con- 3(90 sisting of cows, horses, mules, lacks, jennies, goats and sheep, may be kept within said Zones as they are hereinafter designated. Therefore, be it resolved by the City Commission of the City of Lubbock that the following area within the'corporate limits of said City be divided into three Zones to be known as Zones 1, 2 and 3: Zone No. 1 shall and is hereby declared to include all that area within the following boundaries, viz: BEGINNING at the Mq corner of Carl Roberds Subdivision; THENCE south along Avenue lc� to the St;V corner of Block 31, I.IeCru=eri's--6eoand_.A last}on; Th.niiCE East to the SE corner of Block 1, of J. d. Ellison Addition; THENCE North along Avenue H to the NE corner of Block 40 of the Original Town of Lubbock; THENCE west along 6th Street to the place of beginning. Zone No. 2 shall and is hereby declared to include all that area within the following boundaries, viz: BEGINNING at the NVQ corner of Block 131 Overton Addition; THENCE east along 6th Street across Avenue q to the N@V corner of Carl Roberds Subdivision; THENCE south along Avenue W to 19th Street; THENCE West along 19th Street to College Avenue; THENCE North along College Avenue to the place of beginning. Zone No. 3 shall and is hereby declared to include all that area within the following boundaries, viz: BEGINNING at the Ylv corner of Block 8, University Place, an Addition to the City of Lubbock; ThENCE East along the south line of 19th Street to Avenue THENCE south along Avenue W, to 34th Street; THENCE west along 34th Street to College Avenue; THENCE north along College Avenue to the SE corner of Block 10 Del Iviar Annex Addition to the City of Lubbock; THENCE west along the south boundary line of Del liar Annex to the S,: corner of Block 2 of Del Mar Annex; THENCE north to 26th Street; THENCE West along the south Boundary lime of Del Mar Kddition to the SW corner of B?k.5 of said Del Mar Add!n ; THENCE North along the western boundary line of Del Mar Addfn and the Ellwood Place to a point in the east side of Monroe Street, which point is the NVV corner of Block 31, Ellwood PlAce-Addition; TH i%lCE; VVest across Ivionroe Street to the SE corner of Lot 1 in Block 4, University Place; TnE!VCE West along the sout.,ern boundary line of the University Place to the SeV corner of Lot 12 in Block 5 of University Place; THENCE North along Van Buren Avenue to the place of beginning. Be it further resolved that the term "Livestock" as used in this Resolution shall mean and include any cow, horse, mule, jack, ,jenny, goat and/or sheep. Be it further resolved by the City Commission of the City of Lubbock that a special election is hereby called to be held on the 14th day Of June 052LOSOOD , 1938, at some convenient place within each of the above described livestock zones, and that at such election all qualified voters residing in said zone where said election is held may vote in said election held within said zone on the question of whether he or she is in favor of Livestock being kept within said zone, or whether he or she is opposed to Livestock being kept within said zone. Be it further resolved that the City Commission of the City of Lubbock appoint four citizens who are residents of Zone No. 1, four citizens who reside in 2,one No. 2, and four citizens who reside in Zone No. 3, who are qualified voters under the laws of the State of Texas, to hold said election within their respective zones, and to tabulate and make a return of the results of said election to the City Commission. Be it further resolved by the City Commission that the form of ballot to be submitted to the voters in each of said zones shall be as follows: For the keeping of Livestock within Zone No. Against the keeping of Livestock within Zone No. And be it further resolved that if a majority of the qualified voters in any or all of said zones as they are hereinabove described, vote against keeping Livestock in said zone or zones, then it shall be the duty of the Citi- Commission of the City of Lubbock to pass an ordin- ance prohibiting the keeping of Livestock as that term is herein defined, in said zone or zones so voting against keeping Livestock therein.
