1hereas, the City of Lubbock, did by Ordinance No. 544,
of date January 23rd, 1936, now of record in Volume 198, page 3400
of the Deed Records of Lubbock County, Tars, make a paving assess-
ment against all of Lot No. 1, in Block No. 101, of the Overton
Addition to the City of Lubbock, Lubbock County, Texas, and against
G 'YJ herd, owmr of said loto assessed as a part of Unit No. 84,
for Paving on Avenue "X" in front of said Lot Number 1 above
mentioned, said assessment being for the principal sum of $248.15.
r*nd, +hereas, the said G Herd, tit the tt;,e of such
assessment, occupied said property as his homestead, together with
his family;
And, whereas, the said G ►; Herd has refused to give a
Voluntary Mechanic's and Materialman's Lien to cover said t'aving
lien above mentioned; and
,khereas, by reason of the rafusal of the said G 'Al Herd to
give such Voluntary raving and L. echanic's and Uaterialman's Lien,
such p°iving has never been completed, and no costs accrued to the
City of Lubbock by virtue of said paving Ordinance.
And, ';'�!liereas, it is desired to release the said property
from the lien above mentioned; Intended to be created b'Tr said
Ordinance No. 544;
Now, Therefore, The City of Lubbock, Texas, for and in consideration
of the sum of One & No/100 ($1.00) Dollar, to it cash in hand paid by
the said G 6V Herd, does hereby release, discharge and quit -claim unto
the said G !1 Herd, all its right, title and interest in and to Lot
Number 1, Block Number 101, of the Overton Addition to the City of
Lubbock, Lubbock County, Texas, as to the above assessment in the sum o_
A,0248.15 only, as fully set out in said Ordinance No. 544 for paving
bove mentioned.
But it is fully understood thit this release shall not in any
manner affect the lien for paving in front of said Lot Number 1, and
Lot Number 2, in said Block No. 101, of Overton :addition to the City
of Lubbock, fronting on lith Street, known as Unit Number 67, establish-
ed under Paving Ordinance No. 542, to which reference is here made for
all purposes.
In 'efitnes& whereef, this instrument is officially signed by the
Mayor for the City of Lubbock, hereunto duly aut_ orized by Resolution
of date October 26th, 1935, now of record in Vol. 193, page 229, of the
deed records of Lubboc County, Texas, on thi.:, the 14th day of July,

Before me, the undersigned authority, in and for Lubbock County,
Texas, on this day personally appeared C E Slston, known to me to be
the person whose nane is subscribed to the foreFToing instrument, as
Mayor for the City of Lubbock, Texas, and acknowledged to me that he
executed the same for the purposes and consideration therein expressed,
as the act and deed of said City, and in the capacity therein expressed.
