RE IT RESOLVED PY TAT, CITY OF LTT91?0=2 TEAS: That, Public necessity el,-ists that the followin,v portions of streets, avenues and alleys in the City of Lubbock, Texas, be improved as herein provided, to-�xrit: Avenue 0 from N.P.L. Main Street to S.P.L. 7th Street Avenue N from S.P.L. 16th Street to N.F.L. 17th street Avenue IT from S.P.L. 17th Street to N.F.L. 19th Street Avenue 0 from S.P.L. 16th Street to N.P.L. 17th Street Avenue 0 from S.F.L. 17th Street to N.P.L. 19th Street Avenue J from S.P.L. 16th Street to N.P.L. 19th Street 7th Street from 7I.P.L. Said portions of streets, :avenues and alleys shall be improved by raising, grading, and filling same, and by installing concrete curbs and gutters, and storm sewers and drains 7uhere necessary, and by paving with one of the following types of material on proper foundation, to -wit: a Virtical Fibre 3rick 'a Rock Asphalt (c Ritulithic (d ;arrenite Concrete (e Asphaltic Concrete (f Patented Types of Paving (g Quadruple Top Asphalt --jj-_d Rock The exact type of pavement to be determined by the Comrlission of the City of Lubbock after receipt of bids. III. The City Engineer is hereby directed to prepare plans and specifications for such improvements embracing specific -.tions for each of the s -id types of paving. IV. Such improvements in each Unit or District shall be paid for in the following manner. (�) Railways and street rail-,uays using, occupying, or cross- ing any protion of said streets and avenues to be improved shall 072838A pay for and be assessed for all the cost of ,4!ork in the area between their rails and tracks, doulDle tracks, turnouts, and snitches, and t,a,o feet on each side thereof. (b) The abutting property and owners thereof shall pay an(' shall be assessed for all the cost of constructing curbs in front of such respective properties., and 100 of the remaining cast to such i­provements, after deducting the sums to be paid by rail,,xrays and street raill,rays under sub -paragraph (a) above, provided t' at if it shall appear to the hearing to be had before final assessrr,ent that the special benefits to such property in the enhanced value thereof by rnenas of such improvements 1;Till not aggregate such proportion of cost, then there shall be assessed and be paid by such abutting property, and th.e owners thereof, the amount of such benefits. (c) The remaining cost of said im_�rovemnts, after deducting the sums finally assessed against railways and street railways under sub -paragraph (a) hereof, and against al:utting property and owners thereof under sub-n.aran;raph (b) above, shall be paid by the City of Lubbock. V The amounts to be paid by and assessed against railways and street railways for work between rails and tracks and two feet on each side thereof, shall be payable on estimates as the ­ork progresses as may oe provi.aea in bear interest from date due and u per cent per annum.
