O ALL (,gUALIFI'SD VOTERS OF THE CITY OF LUBBOt$, TEXA^ -1 r1WN TAXABLE.] PROP11TY IN rY, AND WH•'O HAV) DULY •ED THE SAA SE FORrA7�ATI Take no _At an election will be held on the 2nd day of September, 1938, in the City of Lubbock, Texas, to determ- ine whether or not the City Commission of the City of Lubbock, Texas shall be authorized to issue bonds of said city in the aggregate sum of Seven Hundred Fifty Thousand Dollars ($750,0001, to bear interest at a rate not to exceed four per cent (4%) per annum, payable semi- annually, maturing serially within twenty (20) years from their date, for the pur- pose of' the construction of buildings, sewers, and other permanent •improve- ments within the City of Lubbock, and the construction and improvement of -streets of such city for the following .purposes and in the following amounts: Fire Station ------------------ $50,000.00 1 -Street Improvement -------- —.$150,000.00 Storm Sewer -------------- $300,000.00 Sewer Disposal Plant -- __ $250,000.00 And to levy a"tax sufficient to pay the inter-` on said bonds and to provide a sink and with which to pay the prin- cipa maturity, and which election was duly ..oiled and ordered by . that,, certain ordinance of the City Commission of the City of Lubbock, Texas, passed and adopt- ,ed,by said City Commission on the 11th day of August, 1938, which ordinance is made a part of this notice and is, in words and figures, as follows; to -wit: AN ORDINANCE BY THE CITY COM- MISSION OF THE CITY OF LUBBOCK, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF FIRE STATION BONDS IN AMOUT OF. $50,000; STREET IMPROVEMENT BONDS IN AMOUNT OF $150,000; STORM SEWER BONDS IN AMOUNT OF $300,000; SEWER DISPOSAL PLANT BONDS IN AMOUNT OF $250,000 TO BEAR INTEREST AT A RATE NOT TO EXCEED FOUR PER CENT (41,0) PER ANNUM MATURING SERIALLY WITHIN TWENTY YEARS FROM THEIR DATE, AND THE -LEVY OF A TAX SUF- FICIENT TO PAY THE INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND WITH WHICH TO PAY THE PRINCIPAL AT MATURITY, THE PRO- CEEDS OF SUCH BONDS TO BE USED FOR THE PURPOSE OF CONSTRUCTION OF BUILDINGS, SEWERS AND OTHER PERMANENT IMPROVEMENTS WITHIN THE CITY .OF LUBBOCK AND CON- STRUCTION AND IMPROVEMENT OF STREETS OF SUCH CITY; AND DECLAR- ING AN EMERGENCY. Whereas. there have been presented.to the City Commission of the City of Lub- bock, Texas, petitions signed by J. O. Jones and 196 other qualified electors of the City of Lubbock who - own taxable property in said city and who have duly rendered the same for taxation, request- ing that an election be ordered to be held in said city on the question of the issu- ance of bonds for the purpose of the construction of buildings, sewers and other permanent improvements within the City of Lubbock, and the construction and improvement of streets of such city for the following purpose and in the follow- ing amounts; Fire Station ------ $50,000.00 Street Improvement_ $150,000.00 Storm Sewer --------- _, $300,000.00 Sewer Disposal Plant --------- $250,000.00 To -bear interest not to exceed four per cent (4%) per annum, .payable semi-annu- ally, maturing serially within twenty (20) years from their date, and the levy .of it tax sufficient to pay the interest on said bonds and provide a sinking fund with which to pay the principal at maturity; and Whereas, the City Commission of the'I City of Lubbock, Texas, has determin- ed the necessity for the construction of such buildings and improvements; and Whereas, the City Commission has de- termined that an emergency exists for the immediate preservation of the public peace, property, health or safety demand- ing that the rule requiring ordinances to be read on more than one date before final passage be -suspended,. and' ord. inancee adopted as an emergency measure to take effect and be in force immediately upon its passage and approval. NOW, THEREFORE. BE IT ORDAINED BY THE CITY OF LUBBOCK: That an election be held on the 2nd day of September, 1938, at which election the following propositions shall be submitted: PROPOSITION I Shall the City Commission of the City of Lubbock, Texas be authorized to issue the bonds of the City of 'Lubbock, Texas in the sum .of Fifty Thousand Dollars ($50;000), bearing interest not to exceed four per cent (4%) per annum, maturing serially within twenty (20) years from their date, and to levy a tax sufficient to .pay the interest on said bonds and pro- vide a sinking fund with which to pay the pripcipal at maturity, for the purpose of constructing and equipping a fire. station .within the City of Lubbock, Texas, as au- " thorized by the Constitution and laws of the State of Texas? PROPOSITION II Shall the City Commission of the City of - Lubbock, Texas, be authorized to issue the bonds of the City of Lubbock, Texas in the sum of Onehundred Fifty Thousand Dollars !$150,000), bearing interest not to " exceed four per cent (4% ) per annum, maturing, serially within twenty (20) years from their date, and to levy a tax. suffi- cient to pay the interest on said bonds and provide a sinking fund with which to pay the principal at maturity, for the purpose of the construction andlmprove- ment of streets of the City of Lubbock as authorized by the Constitution and laws of the State of Texas? PROPOSITION III Shall the City Commission of the City of Lubbock, Texas, be authorized to issue the bonds of the City of Lubbock, Texas in the sum of Three Hundred Thousand Dol- lars ($300,000), bearing. interest not to ex- ceed four per cent (41/) per annum, ma- turing serially within twenty (20) years from their date, and, to levy a tax sufff, tient. to pay the interest on said bonds and provide a sinking fund with which to pay the principal at maturity, for the purpose of constructing storm sewer improvements within and for the City of Lubbock as authorized by 'the Construction and laws of the State of Texas? PROPOSITION IV Shall the City Commission of the City of Lubbock, Texas, be 'authorized to issue the bonds of the City of Lubbock, Texas, In the sum of Two Hundred Fifty Thous- and Dollars 15250,000) bearing interest not. to exceed four per, cent (410) per annum, maturing serially within twenty (20) years from their date, and to levy a tax suffi- cient to pay the interest on said bonds and provide a sinking fund with which to pay the principal at maturity, for thel purpose of the construction of a Sewer dis- posal plant within and for the City of Lubbock, Texas as authorized by the( Co• 'ition and laws of the State of .Te II Said election shall be held at City Hall in said city, and the following named per sons are hereby appointed officers to hold said election: N. JOHNSON, Clerk III That said election shall be held under '-the provisions of the Constitution and laws of the State of Texas, and 'the Charter of the City of Lubbock, and only qualified electors of the City of Lubbock who own taxable property in said City and who have duly rendered the same for 39—Legal Notices taxation, shall be qualified to vote. IV That all voters who favor the foregoing proposition to issue bonds for the pur- pose of construction and equipping a fire station shall have written or printed on their ballots, the words: "FOR THE ISSUANCE OF BONDS FOR THE PURPOSE OF CONSTRUCTING AND .EQUIPPING A FIRE STATION AND THE LEVY OF A TAX IN PAY- MENT THEREOF. Those opposing shall have written or printed on their ballots, the words: AGAINST THE ISSUANCE OF BONDS FOR THE PURPOSE OF CONSTRUCT- ING AND EQUIPPING A FIRE STATION AND THE LEVY OF A TAX IN PAY- MENT THEREOF. That all voters who favor the forego- ing proposition to issue bonds for the purpose of construction and improvement of streets shall have written or printed on their ballots, the words: "FOR THE ISSUANCE OF BONDS FOR THE PURPOSE OF CONSTRUCTION AND IMPROVEMENT OF STREETS AND THE LEVY OF A TAX IN PAYMENT THEREOF. Those opposing shall have written or printed an their ballots, the words. AGAINST TH ISSUANCE OF BONDS FOR THE PURPOSE OF CONSTRUC- TION AND IMPROVEMENT OF STREETS AND THE LEVY P A TAX IN PAY- MENT THEREOF. That all voters who favor the forego- ing proposition to issue bonds for the purpose of constructing storm sewer im- provements shall have written or printed on their ballots, the words: "FOR THE ISSUANCE OF BONDS FOR THE PURPOSE OF CONSTRUCTING STORM SEWER IMPROVEMENTS AND THE LEVY OF A TAX IN PAYMENT THEREOF." Those opposing shall have written or printed on their ballots, the words: AGAINST THE ISSIIANCE OF BONDS FOR THE PURPOSE OF CONSTRUCT- ING STORM SEWER IMPROVEMENTS AND THE LEVY OF A TAX IN PAY- MENT THEREOF." That all voters who favor the forego- ing proposition to issue bonds for the pur- pose of construction of a sewer disposal plant shall have written or printed on their ballots, the words; !"FOR THE ISSIIANCE OF BONDS FOR THE PURPOSE OF CONSTRUCTION OF A SEWER DISPOSAL PLANT AND THE LEVY OF A TAX IN RAYMENT THERE- OF." V The manner of holding said election shall be governed by the laws of the State' of Texas regulating general" elec- tions. VI j•That notice of said election shall be given by posting and publication of a copy of this order. Said notice shall be posted in each of the election precincts herein designated, and at the City Hall, not less than fourteen (14) days prior to I the date on which said election is to be held, and be published on the same day in each of two successive weeks, in Lub- bock Morning Avalanche, a newspaper of general circulation published in the City of. Lubbock, the first of said publications to be made not less than fourteen (14) days prior to the day set for said elec- tion. VII The fact that the immediate passage and adoption of this ordinance is necessary for the preservation of public peace, -property, health or safety demands that the rules requiring ordinances to be read on more than one date before final pass- age be suspended and such rule is hereby suspended and this ordinance Is adopted as an emergency measure to tale effect and be in force immediately upon its pass- age and approval. .Passed and approved thislith day of "August, 1938.
