P.L. Avenue S to Avenue T 22nd Street from W.P.L. Avenue T to E.P.L. Avenue V 24th Street from E.P.L. Avenue S to E.P.L. Avenue T 25th Street from E.P.L. Avenue S to E.P.L. Avenue T 26th Street from E.P.L. Avenue S to E.P.L. Avenue T 26th Street from .d.P.L. Avenue T to E.P.L. Avenue V 26th Street from I.P.L. Avenue V to E.P.L. Avenue X II. Said portions of streets; avenues and alleys shall be iriproved by raising, grading, and filling same, and by installing concrete curbs and gutters, and storm sei,rers and drains where necessary, and by paving T°ith one of the following types of material on proper foundation, to -,wit: ta) Virtical Fibre Brick (b) - Rock Asphalt (c) Jarrenite Bitulithic (d) Concrete (e) Asphaltic Concrete (f) Patented 'Types of Paving (g) Quadiuple Top Asphalt and Rock The exact type c:'; pavement to be determined by the Commission of the City of Lubbock after receipt of bids. III. The City Engineer is herebJr directed to prepare plans and specifications for such iriprovements embracing specifications for each of the said types of paving. IV. Su®l, improvements in each Unit or District shall be paid for in the following manner: (a) Railways and street railways using, occupying, or crossing any portion of said streets and avenues to be improved shall pay for and be assessed for all the cost of work in the area between their rails and tracks, double tracks, turnouts, and switches, and two feet on each side thereof. (b) `Lle abutting property and. owners thereof shall pay and shall be assessed for all the cost of constructing curbs in front of such respective properties, and 1000 of the remaining cost of such improvements, after deducting the suras to be paid by railways and street railways under sub -paragraph (a) above, provided that if it shall appear to the he, -.ring to be had before final assessment that the special benefits to such property in the enhanced value thereof by means of such improvements will not aggregate such proportion of cost, then there shall be assessed and be paid by such abutting property, and the o?t.*ners thereof, the amount of such benefits. LA 0 031o38C (c) The remaining cost of said improvements, after deducting the suras finally assessed against railways and street railways under sub -paragraph (a) hereof, and against abutting property and the a.-rners thereof under sub -paragraph (b) above, shall be paid by the Cit; of Lubbock. V. The amunts to be paid b;,- and assessed against, railways and street railways for ivork betvieen rails and tracks and two feet on each side thereof, shall be payable on estimates as the .,vork progresses as may be provided in such specifications, and shall bear interest fron date due and until paid at the rate of 6%0 per cent per annum. The amounts to be assessed against and paid by -butting propert7, and the owners thereof in each .Unit shall be 'Day -able in five equal installments, due respectively on or before ten days, 1,2,3 and 4 rears after the completlQ' n and acceptance by the uity Of the iriprovenents in the unit upon which the property abuts, and shall beer interest from date of such completion and acceptance and until paid at the rate of 6 % per annum, payable annually, Nith provision that if defa .V be made in the payment of any inst,-.11ment promptly as the same matures, then at the option of the holder of any such assessment or certificate issued in evidence thereof such default shall mature the entire assessment upon which same is made. VI. Assessments shall be rade and levied and shall be a first and prior lien and personal liability for principal, interest, reasonable attorney's fees and costs of collection, if incurred, all under and in accordance with the Charter, and anendments thereto, noir. in force in this City.
