RESOLUTION ADOPTING AND APPROVING
ENGINEERIS ROLLS OF, STATEMENTS FOR
PORTIONS OF AVENUE"K" AND SUNDRY
OTHER STREETS AND ALLEYS xND AVENUES,
FIXING TIME AND PLACE OF BEARING, AND
DIRECTING THE CITY SECRETARY TO GIVE
NOTICE.
�:IHEREAS, the City of Lubbock has heretofore ordered that the here-
inbelow mentioned portions of streets and alleys and avenues be
improved by raising, grading and filling and paving, and by installing
concrete curbs and gutters on Units Nos. 137, 138, 242, 243, 244, 245,
246, 247, 248, 249, 250, 251, 2520 253 and otherwise; and,
-V':HEREAS, arrangements for the making and construction of said
improvements has been made and entered into by the City of Lubbock
as Contractor, and the City Engineer has made and prepared and filed
with the City his rolls or statements showing the amounts to be
assessed against parcels of abutting property and the owners thereof,
and showing other matters and things, and said statements have been
examined and corrections made where necessary;
THEREFORE, BE IT RESOLVED BY THE CITY
OF LUBBOCK, TESLAS; THAT,

Said rolls or statements be and the same are hereby adopted and
approved.

That a hearing be given and held by and before the City Commission
of Lubbock to the owners of property abutting upon said streets and
alleys to be improved, and to all others in any wise interested or
affected, concerning said improvements, the amounts of the proposed
assessments against abutting property and the owners thereof, con-
cerning the apportionment of the cost of said improvements and the
descriptions of property, names of owners, regularity of proceeding.,
and concerning all other matters and things in connection with which
any is entitled to be heard under the Lava and Charter with amend-
ments in force in said City, and the proceedings of the City with
reference to said improvements.
The portions of streets and alleys so to be improved and in connection
with which such rolls or statements are adopted being set forth in
the form of notice herein below prescribed,
Said hearing shall be held in the regular Commission meeting room
of the City Hall in the City of Lubbock, Texas, on the 9th
day of February , 1939, at 1:30 P.M, and may be continued
from time to time until the purposes thereof are in the opinion of
the �'ommission fully accomplished and such hearing shall in all respects
be conducted in accordance with said charter with amendments, law and
proceedings.
IV.
The City Secretary is directed to give notice of the time, place and
purpose of such hearing by causing notice in substantially the,form
hereinbelow prescribed to be published at least three times prior to

the date of said hearing in a newspaper published in and of general
circulation in the City of Lubbock, Texas, the first of which
publications shall be at least ten days before the date for such
hearing, and the form of which notice shall be substantially as
follows:

The Governing Body of the 9ity of Lubbock has heretofore ordered
that the following portions of streets, avenues and alleys in said
City of Lubbock, Texas, be improved by raising grading and filling and
paving and by installing concrete curbs and gutters on Units Nos. 137,
138, 242, 2 43, 244, 245, 246, 247, 248, 249, 250, 251, 252, 253 and
otherwise, to -wit:
Avenue K from its intersection with the North Property Line of 10th
Street to its intersection with the South Property Line of 9th Street,
plus two thirds 9th Street and Avenue K intersection, known aid
designated as Unit or District No. 137.
Avenue K from its intersection with the North Property Line of 9th
Street to its intersection with the South Property Line of 4th Street,
plus one third 9th Street and Avenue K intersection, known and
designated as Unit or District 138.
14th Street from its intersection with the `best Property Line of
Avenue F to its intersection with the East Property Line of Avenue G,
known and designated as Unit or District No. 242.
Avenue N from its intersection with the South Property Line of 4th
Street to its intersection with the North Property Line of 7th Street,
known and designated as Unit or District No. 243.
Avenue N from its intersection with the South Property Line of 7th
Street to its intersection with the North Property Line of 8th. Street,
known and designated as Unit or District No. 244.
Avenue N from its intersection with the South Property Line of 8th
Street to its intersection with the North xroperty Line of 9th Street,
known and designated as Unit or District No. 245.
Avenue N from its intersection with the South Property Line of 9th
Street to its intersection with the North Property Line of 10th btreet,
known and designated as Unit or District 1�o. 246.
Avenue N from its intersection with the South Property Line of 10th
Street to its intersection with the North Property Line of Main Street,
known and designated as Unit or District No. 247.
Avenue L from its intersection with the South Property Line of 7th
Street to its intersection with the North Property Line of 8th Otreet,
known and designated as Unit or District io. 248.
Avenue L from its intersection with the South Property Line of 8th
Street to its intersection with the North_Property Line of 9th Street,
known and designated as Unit or District No. 249.
Avenue L from its intersection with the South Property Line of 9th
Street to its intersection with the North Property Line of 10th 6treet,
known and designated as Unit or District No, 250.
Avenue L from its intersection with the South Property Line of 16th
Street to its intersection with the North Property Line of 19th Otreet,
known and designated as Unit or District No. 251.
Avenue R from its intersection with the South Property Line of 10th
Street to its intersection with the North Property Line of train Street,
known and designated as Unit or District No. 252.

and arrangement for the making and construction of such improvements
with pavement of quadruple course asphalt surface treatment (Inverted
Penetration Type) on a Six (6) inch compacted caliche base has been
made and entered into by the City of Lubbock, Texas, and rolls or
statements showing the proposed amounts to be assessed against abutting
property and the owners thereof have been filed with the City, such
rolls or statements showing other matters and things, and have been
approved, and the City Commission of said City has fixed a time and
place for hearing to the owners of property abutting upon said portions
of streets, avenues and alleys, and to all others affected, at whi6h
hearing the amounts to be assessed against the respective parcels of
abutting property and the owners thereof for improvements in the units
upon which the particular parcels of property abut, the amounts of
benefits to the respective parcels of property by means of the improve-
ments in the unit upon which the particular property abuts, the
regularity of the proceedings with reference to such improvements, the
apportionment of the cost of such improvements, and other matters and
things will be determined, and after such hearing assess(,ents will by
ordinance be made and levied, and such hearing will be had and held by
and before the City Commission of the City of Lubbock, Texas., in the
regular Commission meeting room in the City Hall, in the City of
Lubbock, Texas, on the —day of , at o'clock.
The rolls or statements showing the proposed amounts of such assess-
ments are on file in the office of the City Secretary and copies there-
of are in the office of the City Engineer of the City of Lubbock and
open to inspection of any interested parties at any time, and of all
said matters and things all such owners of property, as well as any
and others in any wise affected or interested, will take due notice.

No notice other than that hereinabove provided for shall be
necessary, but publication of such notice shall be due and sufficient
notice to any and all persons, firms, corporations and other parties.
This resolution shall take effect and be in force from and after
passage.
