HomeMy WebLinkAboutResolution - 061340A - Release Of Paving Lien - Avenue P From South 19Th St. To South 21St St. - 06/13/1940BE IT REMEMBERED, that on this the 13th day of June, 1940, the City Commission of the City of Lubbock met in reg- ular session it the commission room at the City Fall in the City of Lubbock; a quorum being present, and among other things, the following business was transacted. Commissioner ITewson introduced a resolution which was sec- onded by Commissioner Mcl:illan , said resolution being as follows: :,TIEREAS the City Commission of the City of Lubbock did on the 14th day of L' rch , 19_1, pass ordinance number 6380 which ordinance levied an assessment for street improvement purposes against all abutting property owners on both sides of Avenue P from the South property line of Kine- teenth street, South to the South property line of Twenty- first street, said assessment being described as Unit 281. a portion of AND WHEREAS/said property- so assessed for street improvement purposes was described in said ordinance as be- ing located in I�eCrum mens Second Addition to the City of Lub- bock, Lubbock County, Texas, when it should have read ?�cCrum- mens Addition to the City of Lubbock, Lubbock County, Texas. AND Vv=PF.AS said erroneous description has created. a cloud and an apparent lien on the property of said property ovmers in 1?cCrummens Second Addition to the City of Lubbock, Lubbock County, Texas. THEREFOFE, BE IT RESOLVED by the City Commission of the City of Lubbock, that in consideration of the premises and for the purpose of removing the cloud cast upon the title to the property located and situated on both sides of Avenue P, beginning with. the South property line of Nineteenth street and extending South to the South property line of Twenty-first street, and for the further purpose of releasing any lien or apparent lien which may have been created against said property as described above by virtue of the passage of ordinance number 638, the City Commission does hereby release said paving lien assessment in so far only as it affects the property described above, but it is expressly understood that the paving assess- ment lien levied against all other property described in said ordinance number 638, shall remain in full force and effect, and it is so ordered.
