HomeMy WebLinkAboutResolution - 071140A - Insurance Policy Repealed - Premium Payments Not To Be Paid From City Funds - 07/11/1940i 011140A BE IT REMEMBERED that on the 11th day of July, A.D. 1940, the City Commission of the City of Lubbock met in regular session in the Commission Room at the City Hall, a quorum being present, and, among other things, the following business was transacted; on motion of Co=issioner 7N. B. Price, seconded by Commissioner W. G. McMillan, the following resolution was introduced and duly passed. 111HEREAS, the City Commission of the City of Lubbock, Texas, did on the 27th day of November, 1929, pass a resolution authorizing the payment out of city funds a part of the pre- mium on certain life insurance policies that had been issued by the Aetna Life Insurance Company to various city employees. AND y`�IHERE AS, on July 12th, 1934, the City Commission of the City of Lubbock, Texas, did by resolution duly passed, authorize the payment out of city funds a part of the premium on certain life insurance policies issued by the Great Southern Life I-surance Company to certain city employees. AND IMEREAS, the City Commission has begin advised by the City Attorney that the payment of any part of certain in- surance premiums out of city funds is in contravention of the constitution and lavas of the State of Texas. THEREFORE, BE IT RESOLVED, that the two resolutions described above be and the same are hereby repealed, set aside and held for nought and that from and after the passage of this resolution, the City of Lubbock shall discontinue the payment out of public funds, any part of the premiums due on insurance policies issued to its employees. BE IT FURTHER RESOLVED, that subject to the consent of any city employee owning a policy of insurance issued by the Aetna Life Insurance Company and/or the Great Southern Life Insurance Company dated prior to July 11th, 1940, the City Secretary may cause the amount of the monthly premium maturing thereon to be deducted from said employees' monthly salary check and remit the same to the insurance company issuing said policy of insurance. Ilk 011140A BE IT FURTHER RESOLVED that all insurance written on the lives of city employees from and after July 11th, 1940 by any insurance company, the City of Lubbock will not collect the premiums maturing thereon. BE IT FURTHER RESOLVED that nothing in this resolution shall ever be held or construed to mean that the City of Lubbock objects to its employees carrying life insurance.
