ON THIS the 18th dap of January, j%l, the City
Commission of the City of Lubbock, Texas, convened in Repassed ar
session, at the regular meeting place thereof in the City Hall,
the following members, to wit:

W. B. PRICE, COMMISSIONER NO. 1;
W. 4. MOMILLAN, COMMISSIONER NO. 2;
GARLAND NEWSOk, CCAWSSIONER NO 3;

and, among other prooeedings had, were the following:
Commissioner MoMillan offered the follow-
ing resolution to the City Commission and moved its adoption$
WHEREAS, under and by virtue of a resolution and
order duly passed by the City Commission of the City of Lubbock*
Texas, on the 24th day of December, 1940, an election was held
in said City on the 14th day of January, 1941, on two propositions
for the issuanoe of the bonds of said City of Lubbock, Texas, ad
follows:
PROPOSITION M 1
"WALL the City Commission of the City of
Lubbock, Texas, be authorised to issue bonds of said City,
In the principal sum of SEVENTY-FIVE THOUSAND DOLLARS
($75,000.00) , maturing serially within five (5) years from
their date, bearing interest at a rate not exceeding THREE

I;ER CENTM (3%) per annum, payable semi-annually, and
to levy a tax on all taxable property in said City
sufficient to pay interest on said bonds and provide
a sinking fund with which to pay the principal at
maturity, for the purpose of constructing improvements
and extensiono to the Waterworks System of said City, as
authorized by the Constitution and laws of the State of
Texas?"
PROPOSITION UMBER 2
"SHALL the City Commission of the City Of
Lubbock, Texas, be authorized to issue bonds of said City,
in the principal sura of ONE HUNDRED aEVENTY-FIVE TROUSAND
DOLLARS ($175,000.00), maturing serially within five (5)
years from their date, bearing; interest at a rate net
exceeding THREE PER CENTU1_ (3%) per annum, payable semi-
annually, and to levy a tax on all taxable property in said
City sufficient to pay interest on said bonds and provide
a sinking fund with which to pay the principal at maturity,
for the purpose of constructing improvements and extensions
to the Electric Light slant of said City, as authorized by
the Constitution and laws of the State of Texas?"
AND WHEREAS, on this the 13th day of January,
1941, sane being; a Reoessed ReUulaxtsession of the City Commission,
there came on to be considered the returns of said election; and,
Wwi"' EAS, upon consideration of the returns of the
said election, it appears that the same was in all respects legal-
ly held, after due notice had been given, and that the skid returns
were duly and legally made; and,
wi,jEREAS, it further appears from said returns that
in respect of Proposition Number 1 there were ct:st at said elec-
tion 211 votes, of which number 159 votes were cast

that in respect of Proposition Number 2 there were cast at said
election 210 votes, of which number 146 votes v.,ere

That the proposition to issue the uraterworks
Improvement Bonds, in the sum of $75„000.00, and levy an annual
tax sufficient to pay the interest on said bonds and to provide
the required sinking fund to redeem them at maturity, was sus-
tained by a majority of the -ju€alified property taxpaying voters
of the City of Lubbock, Texas, who own taxable property in said
City and who had duly rendered the sane for taxation,, voting
at said election, and that the City Comulission of the said City
is authorized to issue said bonds and to levy and have assessed
and collected said tax, for the payLient of the principal and
interest of said bonds at naturity thereof.

That the proposition to issue the Electric Light
Plant Improvement Bonds, in the sum of 41750000.001 trnd levy an
annual tax sufficient to pay the interest on said bonds and to
provide the required sinking fund to redeera thew at maturity, was
sustained by a majority of the qualified property taxpaying voters
of the City of Lubbock, Texas, who own taxable property in st.id
City end v�ho had duly rendered the same for taxation, voting at
said election, and that the City Commission of the said City is
authorized to issue said bonds and to levy and have assessed

and collected said tax, for the payment of the principal and
interest of said bonds at maturity thereof,
The above resolution having; been read in full,
the motion of Cormaissioner
.3cldillan was duly seconded
by Commissioner Jones Thereupon, the Layor put
the notion to a vote of the members of the City Commission of
the City of Lubbock, with the request that as many as favored
the resolution to vote ".M11, and all triose opposed to vote
"NO"; the following members of the Commission, to -wit: I-ayor
ilaton and Commis3ioners Price, & cyillan, m= and Jones voted
"AYE"; and none voted "NO."
The h.fiyor declared the motion carried and the
resolution adopted,
PASSED AND APPROVED, this the 18th day of
January, 19416
