RESOLUTION ADOPTING AND APPROVING ENGINEEB'S ROLLS OR
STATEMENTS FOR PORTION OF AVENUE "H", FIXING TIME AND
PLACE OF HEARING, AND DIRECTING THE CITY SECRETARY TO
GIVE NOTICE.
WHEREAS, the City of Lubbock has heretofore ordered that the
hereinbelow mentioned portion of Avenue "H" be improved by removing
present narrow brick pavement and replacing a wide pavement and baising,
grading and filling and paving, and by installing concrete curbs and
gutters on Unit No. 391 and otherwise; and,
WHEREAS, arrangements for the making and construction of said
improvements has been made and entered into by the City of Lubbock, as
Contractor, and the City Engineer has made and prepared and filed with
the City his rolls or statements showing the amounts to be assessed against
parcels of abutting property and the owners thereof, and showing other
matters and things, and said statements have been examined and corrections
made where necessary:
THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS; THAT,
I.
Said rolls or statements be and the same are hereby adopted and
approved.
II.
That a hearing be given and held by and before the City
Commission of Lubbock to the owners of property abutting upon the said
Avenue "H" to be improved, and to all others in any wise interested or
affected, concerning said improvements, the amounts of the proposed assess-
ments against abutting property and the owners thereof, concerning the
apportionment of the cost of said improvements and the descriptions of
property, names of owners, regularity of proceedings, and concerning all
other matters and things in connection with which anyone is entitled to
be heard under the Law and Charter with amendments in force in said City,
and the proceedings of the City with reference to said improvements.
The portion -of Avenue "H" so to be improved and in connection
with which such rolls or statements are adopted being as set forth in
the form of notice herein below prescribed,

Said hearing shall be held in the regular Commission meeting
room in the City Hall in the City of Lubbock, Texas, on the 27th
day of i{ebruai , A.D. 1941 at 1:30 o'clock '. M, and
may be continued from time to time until the purposes thereof are in the
opinion of the Commission fully accomplished, and such hearing shall in
all respects be conducted in accordance with said charter with amend-
ments, law and proceedings.
IV.
The City Secretary is directed to give notice of the time,
place and purpose of such hearing by causing notice in substantially the
form hereinbelow prescribed to be published at least three times prior
to the date of said hearing in a newspaper published in and of general
circulation in the City of Lubbock, Texas, the first of which publi-
cations shall be at least ten days before the date for such hearing,
and the form of which notice shall be substantially as follows:

The Governing Body of the City of Lubbock has heretofore ordered
that the following portion of Avenue "H" in said City of Lubbock, Texas,
be improved by removing the present narrow brick pavement and placing a
wide pavement and by raising, grading and filling and paving and by in-
stalling concrete curbs and gutters on Unit. No. 391, and otherwise, to -wit:
Avenue H from its intersection with the South Property Line of 16th
Street to its intersection with the South Property Line of 19th Street,
as produced from the `Vest, known and designated as Unit or District No.
391 -
and arrangement for the making and construction of such improvements
with pavement of quadruple course asphalt surface treatment (Inverted
Penetration Type) on a Six (6) inch compacted caliche base, has been
made and entered into by the City of Lubbock, Texas, and rolls or state-
ments showing the proposed amounts to be assessed against abutting pro-
perty and the owners thereof have been filed with the City, such rolls
or statements showing other matters and things, and have been approved,

and the City Commission of said City has fixed a time and place for
hearing to the owners of property abutting upon said portion of Avenue
"H" and to all others affected, at which hearing the amounts to be assess-
ed against the respective parcels of abutting property and the owners
thereof for improvements in the unit upon which the particular parcels
of property abut, the amounts of benefits to the respective parcels of
property by means of the improvements in the unit upon whic',� the particu-
lar property abuts, the regularity of the proceedings with reference to
such improvements, the apportionment of the cost of such improvements,
and other matters and things will be determined, and after such hearing
assessments will by ordinance be made and levied, and such hearing will
be had and held by and before the City Commission of the City of Lubbock,
Texas, in the regular Commission meeting room in the City Hall, in the
City of Lubbock, Texas, on the 27th day of 1''eb. 1941, at 1:30
o'clock, -'• M. The rolls or statements showing the proposed amounts
of such assessments are on file in the office of the City Secretary, and
copies thereof are in the office of the City Engineer of the City of
Lubbock and open to inspection of any interested parties at any time,
and of all said matters and things all such owners of property, as well
as any and others in any wise affected or interested, will take due notice.

BE IT R .M.'BERED, that at a Recessed Recular I.:eeting of the City
Commission_ of the Ci ty of Lubbock, Lubbock County, Texas, held in the
pity Hall, on the .7th day of Larch, 1941, a quorum being present, upon
motion by Commissioner Jones, seconded by Commissioner I•lcl. illah,
the following Resolution was duly passed.
r EREAS, the City of Lubbock is =N enjoying a rapid growth in
population and many new residences and homes are now being built raithin
the Corporate limits of said City, requiring the extension of Sewer
Lines and '.later I,ains; and whereas, the City of Lubbock is paving many
new streets and expending sums of -money in marking said streets; and
1RE�1S, the demand for additional garbage service has been increased,
all of which has entitled and required the expenditure of substantial
sums of money; and
�IERrS, the City of Lubbock, at the present time is in great need
of :17,500.00 in cash to properly carry on the improvements named
above.
ITO-;l, TlzEREFORE, BE IT RSSOLVED by the City Comrlission of the amity of
Lubbock, Texas, that C.E. Slaton, Mayor of said pity, be and he is
hereby authorized and empo7,jered to negotiate a six (6) months loan
for the City of Lubbock, not to exceed 9`17,500.00 in cash, for the
purpose of making extensions of seiier lines, water mains, increasing the
garbage service and carrying on the paving of streets, and the said
C.E. Slaton, L:ayor, is further authorized and empowered to execute
ti2��e warrants t: be payable out of current revenue to evidence and
secure the payment of said loan. Rate of interest not to exceed 4%.

A RESOLUTION APPOINTING CERTAIN INDIVIDUALS TO
CONSTITUTE THE BOARD OF ADJUSTIViENT AS MADE AND PROVIDED IN THE
BONING ORDINANCE.
BE IT REMEMBERED that on the 10th day of April
A. D. 1941, the City Commission met in regular session at its
usual meeting place in the City Hall, a quorum being present,
the following business was transacted:
Upon motion of Commissioner W. G. McMillan,
seconded by Commissioner Garland Newsom, the following resolution
was unanimously passed:
BE IT RESOLVED by the City Commission of the
City of Lubbock, that in accordance with the provisions of
Section 23 of the zoning ordinance, the following named persons
are hereby appointed as members of the Board of Adjustment of
the City of Lubbock, Texas, to serve for a period of two years:
K. T. Thomas, J. A. Fortenberry, W. L. Bradshaw, G. W. Parkhill
and Owen W. McWhorter.
