RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and
on behalf of the City of Lubbock, a Quitclaim Deed associated with a portion of an alley
according to the plat thereof recorded in Volume 485, Page 295 of the Deed Records of
Lubbock County, Texas, by and between the City of Lubbock and Benton Oil Company, Inc.,
and related documents. Said portion of an alley was previously closed, vacated, and
abandoned by City of Lubbock Ordinance No. 2021-00061, passed on second reading by the
City Council of the City of Lubbock on June 8, 2021. Said Quitclaim Deed is attached hereto
and incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.

QUITCLAIM DEED
THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK
THAT the CITY OF LUBBOCK, a Home Rule Municipality in the County of Lubbock,
State of Texas, hereinafter called "GRANTOR", for and in consideration of the sum of TEN AND
NO/100 DOLLARS ($10.00) and other good and valuable consideration to GRANTOR in hand
paid by BENTON OIL COMPANY, INC., hereinafter called "GRANTEE", the receipt of which
is hereby acknowledged, does hereby by these presents ABANDON, DISCLAIM, RELEASE and
FOREVER QUITCLAIM unto the said GRANTEE, all of GRANTOR'S rights, title and interest
in and to that certain tract or parcel of land lying and being situated in the County of Lubbock
State of Texas, more particularly described in attached Exhibit "A".
Reservations From Conveyance:
GRANTOR reserves and excepts from this conveyance an easement on the property
described above, and such easement is reserved and retained for utility easement purposes and
garbage collection purposes with the right of ingress and egress at all times for such purpose, and
an easement is also reserved for any and all existing pipelines or other utilities within said property
together with all rights appurtenant to the continuation of such utilities.
THE QUITCLAIM OF THE PROPERTY IS ON A "WHERE IS", "AS IS" AND "WITH
ALL FAULTS" BASIS, AND IS WITHOUT REPRESENTATION OR WARRANITY
WHATSOEVER, EXPRESSED, STATUTORY OR IMPLIED, INCLUDING, BUT WITHOUT
LIMITATION, AS TO TITLE, INCLUDING, BUT NOT LIMITED TO THE EXISTENCE OF
LIENS AGAINST THE PROPERTY, THE DESCRIPTION, PHYSICAL AND
ENVIROMENTAL CONDITION OF THE PROPERTY, QUALITY, VALUE, FITNESS FOR
PURPOSE, MERCHARNTABILITY, OR OTHERWISE.
TO HAVE AND TO HOLD the same premises together with all and singular the rights,
privileges and appurtenances thereto in any manner belonging unto the said GRANTEE, its
successors and assigns forever, so that neither the GRANTOR, its successors or assigns, nor any
persons claiming under GRANTOR shall at any time hereafter have, claim or demand any right to
the title to the aforesaid premises or appurtenances or any part thereof.

BEGINNING at a point on the south lot line of Lot 5 of said Hewett Subdivision, being the
southeast corner of a save & except being described in the deed to Benton Oil
Company, recorded in Volume 1537, Page 320, Deed Records, Lubbock County,
Texas;
THENCE NORTH 900 00' 00" EAST, with the south lot lines of Lots 5, 4, and 3 of said
Hewett Subdivision, a distance of 172.50 feet to the southeast lot corner of said
