HomeMy WebLinkAboutResolution - 2021-R0250 - Quitclaim Deed with Benton Oil Company Hewett AdditionResolution No. 2021-R0250 Item No. 6.6 July 27, 2021 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, a Quitclaim Deed associated with a portion of an alley according to the plat thereof recorded in Volume 485, Page 295 of the Deed Records of Lubbock County, Texas, by and between the City of Lubbock and Benton Oil Company, Inc., and related documents. Said portion of an alley was previously closed, vacated, and abandoned by City of Lubbock Ordinance No. 2021-00061, passed on second reading by the City Council of the City of Lubbock on June 8, 2021. Said Quitclaim Deed is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Reservations From Conveyance: GRANTOR reserves and excepts from this conveyance an easement on the property described above, and such easement is reserved and retained for utility easement purposes and garbage collection purposes with the right of ingress and egress at all times for such purpose, and an easement is also reserved for any and all existing pipelines or other utilities within said property together with all rights appurtenant to the continuation of such utilities. THE QUITCLAIM OF THE PROPERTY IS ON A "WHERE IS", "AS IS" AND "WITH ALL FAULTS" BASIS, AND IS WITHOUT REPRESENTATION OR WARRANITY WHATSOEVER, EXPRESSED, STATUTORY OR IMPLIED, INCLUDING, BUT WITHOUT LIMITATION, AS TO TITLE, INCLUDING, BUT NOT LIMITED TO THE EXISTENCE OF LIENS AGAINST THE PROPERTY, THE DESCRIPTION, PHYSICAL AND ENVIROMENTAL CONDITION OF THE PROPERTY, QUALITY, VALUE, FITNESS FOR PURPOSE, MERCHARNTABILITY, OR OTHERWISE.
