HomeMy WebLinkAboutResolution - 072342A - Condemnation Proceedings - Ellwood Place, Lot 4 Block 7 - 07/23/1942. rnzawz,a BE IT REMEMBERED that at a meeting of the City Commission held at the City Hall in Lubbock, Texas, on the 241,u'�4/,day of July, 1942, upon motion of Commissioner Jones: seconded by Commissioner i'rice , the following resolution was introduced and duly passed: VVHEHEAS, heretofore, to wit: On the 9th day of July, 1942, the City Commission by resolution duly passed,' authorized Durwood H. Bradley, City Attorney, to enter into negotiations with Dr. V. V. Clark and wife, Clyde Clark, for the purchase of a strip of land 15 feet vide across Lot 4, Block 7 of Ellwood Ylace, an Addition to the City of Lubbock, Lubbock County, Texas, described by metes and bounds as follows: and, BEGINNING at a point in the East line of Lot 4, Block 71, Ellwood Place, 249 feet South of the Northeast corner of said Lot 4, Block 7; THENCE West 194 feet; THENCE North 9 feet; THENCE East 7 feet; THENCE North 6 feet; THENCE East 187 feet; THENCE South 15 feet to the place of beginning; WHEREAS, the said Durwood H. Bradley was authorized to offer the said Dr. V. V. Clark and wife, Clyde Clark, the sum of $775.00 for said land; and, WHEREAS, the said Dr. V. V. Clark and wife, refused to accept the sum of X775.00, and refused to nego- tiate with the City of Lubbock through its agent, Durwood H. Bradley and the said Dr. V. V. Clark advised the said Durwood H. Bradley that under no circumstances would he sell to the City said strip of land to be used for an alley; and, WHEREAS, it is necessary for the City of Lubbock to acquire title to the above described land for the conven- ience of the public and to preserve a sanitary condition in said City of Lubbock and to protect the health of the public; THEREFORE, BE IT RESOLVED by the City Commission of the City of Lubbock that Lurti?ood H. Bradley, City Attorney, 0IZ34zA �... be and he is hereby authorized and directed to institute condemnation proceedings as provided by law and to have said above described land condemned, according to law so that the same can be used as an alley for the convenience and for the protection of the health of the general public in the City of Lubbock and, IT IS SO ORDERED.
