I'..'i., with the following members present, viz: Honorable C. A. Best -Tick, John Spikes, J. Ray Dickey, - . B. Price, Lavenia Williams, IiIayor and Presiding Officer Commissioner Commissioner Commissioner Secretary F. H.'Childress, Commissioner, absent and excused due to illness. The said Commission consti�utinf, a quorum for all purposes under the Charter of the City of Lubbock, whereupon the follo.^int;, among other business was transacted: Comrs:issioner John Spikes introduced a resolution and moved its adoption. The motion was seconded by Commissioner 7. E. Price. The motion carryin,� with it the adoption of the resolution prevailed by the following vote: AYLS: Commissioners John S;oi?:es, id. B. OW547A T -t=, by Ordinance No. 811, adopted by the City Commission on the 25th day of April, 19+71 and now recorded in Volume 3, at Page 121 of the Ordinance Register of the City of Lubboc,c, this City Commission ordered an election to be hold within and throughout the limits of the City of Lubbock on the fourth Saturday in 11ay, the same being the 24th day of ':ay, 1947, for the purpose of submitting to the resident qualified electors of said City, who own property within said City subject to taxation and who have duly rendered the same for taxation, one proposition to determine whether or not the City Commission of the City of Lubhock shall be authorized to issue the negotiable interest bearinZ coupon bonds of said City= to the amount of X500,000, bearing interest at a rate not exceeding three and one-half (3-1/2;0 percent per annum from date, and maturing at such time or tires as may be deemed most expedient, serially, not later than 25 years from their date for the purpose of erecting, construction, equipping and ma.intainir a public library building in the City of Lubbock, and for such purposes as is more fully set -forth in said ordinance, which said ordinance is hereby referred to and adopted herein by such reference for all Pertinent purposes; and, 41REAS, such election was duly held in a lawful manner and at the time and places provided for in said ordinance, and it is affirmatively found and declared by this Commission_ that due and legal notice was liven for the time and place, in the manner as prescribed by the laws of the State of Texas, the affidavit of posting and publishing such notice having been examined by this Commission and having been found to be in all respects sufficient; and, �'tiElzS, the Judges of such election havinU made due and legal returns thereof to this City Commission, together raith the poll lists and tally sheets maintained during such election and the City Commission having examined in to the election, the manner of holding same and having duly considered such returns: THEREFORE, BE IT RESOLVED BY THE CITY CGi.gwjISSIOD OF THE CITY OF LU13!f OC Y, TEXAS: I. That said election was duly and legally called; that notices thereof were given in accordance with the Constitution and statutes of the State of Texas and the Charter of the Cit;,, of Lubbock, as well as the ordinance mentioned herein; that the election was held in strict conformity with the Constitution and statutes of the State of Texas and the Charter and ordinance of the City of Lubbock; that due returns of said election have been made by the proper officers thereof; that only qualified electors residing in the City of Luhbock, who owned property subject to taxation within the said City and who had duly rendered the same for taxation were permitted to vote in said election. II. That from the returns duly and legally made to this Commission and properly canvassed by this Commission it is found and declared that the oroposition was ap)roved and sustained by the following vote: On the proposition there were cast 820 votes, of which number there were cast: "FCH THE ISSUANCE OF THE LIKURY BUILDING BONDS AND THE LEVEYING OF TAXES IN PAYMNT TH1+;REOFn - - - -635 Votes "AGAINST THE; ISSUANCE OF TIE LIB_=ARY BUILDING BO \iDS AND THE LEVEYING OF TAXES IN PAY.11idT TEEREOF". - - - 185 Votes MAJORITY "FOB. TfM ISSUANCE OF THE LIBRAPY BUILDING BONDS AND THE LEVEYING OF TAXESIN- - - - - - PAYNE, NT TIMREOF" . - 450 Votes It is therefor further ordered and declared by the City Commis- sion that a majority of the qualified resident electors of the City of Lubbock, who own property within said City subject to taxation and who had duly -rendered the same for taxation voting at an election held for such purposes on May 24, 1947, in the City of Lubbock, voted favorably upon the said issue and proposition and that ty virtue of the mandate of such qualified electors, this City Cbmmissicn has been fully and legally authorized to issue such bonds and to levy taxes in pay- ment thereof. That the City Commission of the City of Lubbock, Texas, be and OU0547A is hereby in all respects authorized, ordered and directed to issue said bonds and each of them, and to do any and all things necessary, convenient and recluisite to carry out the expressed desire of such voters in the issuance, sale and delivery of such bonds and the ex- ,pending of the proceeds to be derived therefrom for the Dumases authorized. That all further orders, resolutions and ordinances passed and adopted in connection therewith shall be pursuant to the authority vested in said City Commission by virtue of such election and that all future action be reserved for further meetings of this Commission. -Passed, approved and adopted this the 5th day of June, A.D., 1947. 1':.ayor, City of .Lubbock, Texas.
