BE IT RESOLVED BY THE CITY COit+IIVffSSION OF THE CITY OF LUBBOCK:
SECTION 1. That Lubbock Machine Company, a corporation, with T. A. Rogers its
President, domociled in Lubbock County, Texas, is hereby granted a license to -
gether with all rights of ingress and egress for the purpose of laying and main-
taining a gas line over real estate belonging to the City of Lubbock at the follow-
ing location in Lubbock County, Texas, to -wit:
In Survey 80, Block A, Lubbock County, Texas;
Beginning at a point in Survey 80, Block A, said point being the inter-
section of the Southeastern Right -of -Way line of the Crosbyton Branch
of the Santa Fe Railway and the Eastern Right-of-way line of the pro-
posed extension of Avenue A; THENCE Southeast to a point 7 feet from
said Santa Fe Right -of -'Way line; THENCE 7 feet frori And parallel to
said Southeastern Santa Fe Right-of-way line a distance of approximately
875 feet to the present West Texas Gas Company meter installation and
Gas line.
The consideration for this license is One (41.00) Dollar per year payable
annually in advance by the Lubbock T4achine Company, Incorporated, with all rights
to inure to said corporation and its assigns, subject to the full right of the
City of Lubbock to revoke this license at any time such revocation is found to
be in the public interest by the Governing Body, and the further right on the part
of the City of Lubbock to change or cause a change in the location of said gas
line to meet all requirements at any time made by the City of Lubbock, acting
through the City Engineer.
SECTION 2. The rights herein granted Licensee shall in all events be construed
to be subordinate to the rights and needs of the City of Lubbock, and Licensee
by the acceptance of this license and easement, agrees that any and all removals,
modifications or changes required by the City of Lubbock, or its authorized agents,
pertaining to the gas line shall be at the cost of Licensee and its assigns, and
Licensee agrees to reimburse and hold the City of Lubbock harmless from any and
all. costs and/or damages pertaining to said gas line, and in the event of any
loss, damages, costs and/or expense pertaining thereto suffered by the City of
Lubbock, said Licensee and its assigns will upon demand indemnify the City of
Lubbock therefor.
PASSED AND APPROVED by unanimous vote of the Commission this 23rd day of
October, 1947.
