WHEREAS, the City of Lubbock, has, through its City Manager, attempted to
agree with Lois Marie Scharnberg on the value of her. property needed for 34th
Street right-of-way, described as follows:
Beginning at the Southwest corner of Copp Addition which is a point on
the South section line of Section 91 Block B, Lubbock,County, Texas,
and 472..5 feet from the Southwest corner of said Section 91 Block B;
THENCE East along the said South section line Section % Block B, a
distance of 647.5 feet to the Soithwest corner of tract being describ-
ed; THENCE North 32.5 feet to Northwest corner of said tract; THENCE
East 150 feet to the Northeast corner of said tract; THENCE South
32.5 feet to the Southeast corner of said tract and the South Section
line of said Section 9, Block B; THENCE West 150 feet along said
South section line of Section 9, Block B, to the Southwest corner of
said tract.
WHHERF;AS, Lois Marie Scharnberg has refused to accent the offer made by the
City of Lubbock, as E'oresaid, and,
WHEREAS, the City and Lois Marie Scharnberg have failed to agree on the value
of said tract of land, and,
WHEREAS, the said above described tract of land is needed for highway and
street purposes and the owners and the City having failed to agree on the value
of said tract of land, THEhEFOEE,
BE IT hESOLVED BY THE CITY CO'.41MISSION OF THE• CITY OF LUBBOCK, TEXAS:
THAT, the City Attorney BE, and he is hereby authorized to file and prosecute
to the final concl,zsion, condemnation proceedings, and acquire the fee simple
title to the above described tract of land.
Passed and annroved by unanimous vote of the City Commission this the
l4 ttih day of November, 1947.
