HomeMy WebLinkAboutResolution - 120347B - Canvassing And Declaring Results Of Election - House Bill 34, Senate Bill 36 - 12/03/19471203470 STATE OF TEXAS COUNTY OF LUBBOCK CITY OF LUBBOCK RESOLUTION CANVASSING RETURNS IN ELECTION CIVIL SERVICE AND MINIMUM SSALARIES FOR FIREMEN AND POLIC&VIEN BE IT REMEMBERED, that on this the 3rd day of December, A.D., 1947, the City Commission of the City of Lubbock convened in Special Session at the regular meeting place thereof in the City Hall Building in Lubbock, Texas, at 10:00 otclock A.I., with the following members present, viz: C. A. Bestwick, Mayor and Presiding Officer, and Commissioners John Spikes, J. Ray Dickey, W. B. Price, F. H. Childress, and Lavenia Williams, City Secretary, constituting the entire commission, whereupon the following, among other business was transacted. Commissioner F. H. Childress introduced a resolution and moved its adoption. The motion was seconded by Commissioner John Spikes. The motion carrying with it the adoption of the resolution which prevailed by the following vote: AYES: Commissioners W. B. Price, J. Ray Dickey, John Spikes and F. H. Childress and Mayor Commissioner C. A. Bestwick. NOES: None The resolution is as follows: RESOLUTION CANVASSING RETURNS AND DECLARING RESULTS OF AN ELECTION HELD WITHIN, FOR AND THROUGHOUT THE CITY OF LUBBOCK, TEXAS, ON DECEMBER 2, 1947, TO DETERMINE WHETHER OR NOT THE CITY OF LUBBOCK WOULD ADOPT THE PROVISIONS OF HOUSE BILL NO. 34, RELATING TO CIVIL SERVICE FOR FIREMEN AND POLICEMEN AND WHETHER OR NOT THE PROVISIONS OF SENATE BILL NO. 36, MOULD BE ADOPTED RELATING TO MINIMUM SALARIES FOR FIREMEN AND POLICEMEN. WHEREAS, by Ordinance No. 831, dated October 23, 1947, and now recorded in Volume 31 Pages 173 and 174, of the Ordinance Books of the City of Lubbock, this Commission ordered an election to be held within the City of Lubbock on December 2, 1947, for the purpose of submitting to the resident qualified voters of said City two (2) separate propositions to determine whether or not the provisions of House Bill No. 34, passed at the Regular Session of the 50th 12.47$ Legislature and relating to Civil Service for Firemen and Policemen, would be adopted; and, PwIIEREAS, the City Commission submitted another proposition re- lating to the adoption of minimum wages for Firemen and Policemen as provided by Senate Bill No. 36 of the Regular Session of the 50th Legislature, and said election having been ordered by the provisions of Ordinance No. 832, dated October 23, 1947, and recorded in Volume 3, Pages 175 and 176 of the Ordinance Books of the City of Lubbock; and, WHEREAS, such election was duly held at the time and place pro- vided for in said Ordinance and it is affirmatively found and de- clared by this Commission that due and legal notice of such elec- tion was given for the time and in the manner as prescribed by the laws of the State of Texas, the affidavit of posting and publishing such notice having been examined by this Commission and having been found to be in all respects sufficient; and, WHEREAS, the Judges of such election have made due and legal returns thereof to this City Commission, together with the poll lists and tally sheets maintained during such election and the City Commission having examined in to the election, the manner of holding same and having duly considered such returns; THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, TEXAS: I. That said election was duly and legally called and due notice thereof given and the election was held in conformity with the Constitution of the State of Texas, its statutes, the Charter of the City of Lubbock and said ordinance; that due returns of said election having been made by the proper officers thereof; that only qualified voters of said City were permitted to vote in said election. II. That from the returns duly and legally made to this Commission and properly canvassed by this Commission it is found and declared that the two propositions were approved and sustained by the follow- ing vote: (a) On the proposition relating to Civil Service for Firemen and Policemen 1054 votes were cast, of which number there were cast: FOR THE ADOPTION OF THE PROVISIONS OF HOUSE BILL NO. 34, PASSED AT THE REGULAR SESSION OF THE 50TH LEGISLATURE, PROVIDING CIVIL SERVICE FOR FIREMEN AND POLICEMEN - - - - - 547 votes AGAINST THE ADOPTION OF THE PROVISIONS OF HOUSE BILL NO. 34, PASSED AT THE REGULAR SESSION OF THE 50TH LEGISLATURE, PROVIDING CIVIL SERVICE FOR FIREMEN AND POLICEMEN - - - - - 507 votes MAJORITY, FOE, THE ADOPTION OF THE PROVISIONS OF HOUSE BILL NO. 342 PASSED AT THE FEGULAR SESSION OF THE 50TH LEGISLATURE, PROVIDING CIVIL SERVICE FOR FIREMEN AND POLICEMEN - - - - - - - - - - - - - - - - - - - - - - -- 40 votes (b) On the proposition relating to minimum salaries for Fire- men and Policemen there were cast 1061 votes, of which number there were cast: FOR THE ADOPTION OF THE PROVISIONS OF SENATE BILL NO. 36, PASSED BY THE REGULAR SESSION OF THE 50TH LEGISLATURE, PROVIDING MINIMUM SALARIES FOR FIREMEN AND POLICEMEN - - - 556 votes AGAINST THE ADOPTION OF THE PROVISIONS OF SENATE BILL N0. 36, PASSED BY THE REGULAR SESSION OF THE 50TH LEGISLATURE, PROVIDING MINIMUM SALARIES FOR FIFEMEN AND POLICEMEN - - - 505 votes MAJORITY, FOR THE ADOPTION OF THE PROVISIONS OF SENATE BILL NO. 36, PASSED BY THE REGULAR SESSION OF THE 50TH LEGISLATURE, PROVIDING MINIMUM SALARIES FOR FIREMEN AND POLICEMEN - - - - - -------- --------- 51 votes It is therefore further ordered and declared by the City Commission that a majority of the qualified voters of the City of Lubbock voting at the election held for such purposes on December 2, 1947, in the City of Lubbock, voted favorably upon each of said propositions and that by virtue of the mandate of such qualified voters the City of Lubbock has thereby adopted, to all intents and purposes, the provisions of House Bill No. 34, passed at the Regular Session of the 50th Legislature providing Civil Service for Fire- men and Policemen, as well as the provisions of Senate Bill No. 362 passed by the Regular Session of the 50th Legislature, the same being designated as Article "1583-211, providing minimum salaries for Firemen and Policemen. izo3478 That by reason of such majority vote constituting an adop- tion of such provisions and mandate to the City Commission to make such provisions effective, the said provisions are hereby in all things declared to be accordingly effective.
