HomeMy WebLinkAboutResolution - 082648A - Warranty Deed - Purchasers Of Any Spaces, Lots, Blocks For Interment Purposes - 08/26/1948WHEREAS, the City of Lubbock is the owner of land constituting the Lubbock Cemetery, and described in a certain conveyance of record in Volume 362,.Page 351, Deed Records of Lubbock County, Texas, and which has been divided in to spaces! and lots and blocks for purpose of interment,, according to plate recorded in Volume 26, Page 192; Volume 81, Page 551 Volume gl, Page 139; Volume 90, Page 273; - Volume 90, Page 274, and an additional plat recorded in Volume 271, Page 302, of the Lubbock County Deed Records; and, WHOMAS, said tracts are to be sold and conveyed by the City of Lubbock at prices recommended by the Cemetery Board and approved by the City Commission, EWRE, BE IT RESOLVED BY THE CITY COMaSSION OF.THE CITY OF LUBBOCK: THAT, the Mayor or Mayor pro tem of the City of Lubbock, BE, and he is hereby authorized to convey by warranty deed to the purchasers.. any of said lots for interment purposes at prices per space approved by the City Commission. Each conveyance shall contain substantially the following provisions sThe City of Lubbock covenants to furnish such reasonable care and maintenance of the spaces herein conveyed as shall be determined by the regulations of the Cemetery Board and approved by the Governing Body of the City of Lubbock; and this conveyance is made subject to all such regulations and amendments thereto, PROVIDED HOWEVER, that no curbing, shrubs or other improvements or other structures shall ever be placed thereon except a head- stone# unless expressly authorized by such regulations** It is further provided, that there shall be kept by the City Auditor, or under his direction and control, in a permanently well bound book, all sale transactions relating to the Lubbock Cemetery which shall show. (1) the name of the purchaser, (2) the spaces conveyed, (3) the date of the conveyance, and (4) the sale price. ' It is further provided that where spaces have been sold prior to conveyance Or the cemetery to the City of Lubbock and satisfactory proof is made that the purchaser has paid for such space or spaces, but the conveyance to the Grantee has not been recorded, that the Mayor may, and he is hereby authorised to execute quit claim deeds to such tracts on behalf of the City of Lubbock. The purchase price of spaces shall be paid to the City Auditor upon delivery of any deed so executed by the Mayor.
