i RESOLUTION
WHERE,.S, on June 5, 1947, by Ordinance No. 812, duly enacted by the City
Commission of the City of Lubbock, an assessment lien was created affecting all of
Blocks 115 and 116, McCrummen's Second Addition to the City of Lubbock, Lubbock
County, Texas, and.,
WHEREAS, the ordinance intended to secure payment for paving on and along 32nd
Street, and the South three-quarters! of Blocks 115 and 116 does not abut, nor does
same touch 32nd Street and the owners of the said South three-quarters of Blocks
115 and 116 desire a release of the lien as to said property due to the fact that
no paving is to be done on any street or avenue or alley abutting the said South
three-quarters of Blocks 115 and 116, McCrumments Second .Addition to the City of
Lubbock, Lubbock County, Texas, by virtue of said Ordinance No. 512, THEREFORE
BE IT RESOLVED BY THE CITY =11ISSION CF THE CITY OF LUBBOCK:
THAT, in consideration of the premises, the Governing Body of the said City of
Lubbock does by these presents release the South three-quarters of Blocks 115
and 116, McCrummen's Second Addition to the City of Lubbockp Lubbock County, Texas,
from any and all liens and/or claims for paving which have or might be created
by virtue of the provisions of said Ordinance Ido. 812 of the City of Lubbock,
Texas.
It is expressly understood that any and all liens, rights and privileges of the
�- City of Lubbock created by Ordinance No. 812, as to the remaining portion of said
Blocks 115 and 116 aforesaid, are in all things retained and unaffected by this
release and that this release is intended to release only the South three-quarters
of Blocks 115 and 116 aforesaid. The Mayor is hereby authorized to execute and
deliver a release to the South three-quarters of said Blocks 115 and 116 in
accordance with this resolution.
Passed and approved by unanimous vote of the City Commission this 22 day
of January, , 1948.

THAT'Is G. A. Bestwick,, Mayor of the City of Lubbock, by virtue of a resolution -
duly passed by the Governing Body of the City of Lubbock on the 22 day of
January,. A. D.., 194,8, and in consideration of the hereinafter described property
not receiving any benefits of the improvements as specified in Ordinance No. 812
heretofore passed by the Governing Body of the City of Lubbock, and for the con-
sideration that said hereinafter described property, or any portion thereof, does
not abut,upon any other improvements contemplated in said Ordinance No. 812,
aforesaid, and due to the fact that said ordinance creates a certain paving lien
upon the said described property and thereby creates a cloud on the title to the
said property, do by these presents fully release and discharge paving lien
assessment, and liens against all of the South three-quarters of Blocks 115 and
116., McCrumments Second Addition to the City of Lubbock, Lubbock County., Texas,
created by virtue of said Ordinance No. 812 of the City of Lubbock, Lubbock County,
Texas,
It is expressly understood herein that this release only releases the assess-
ment lien on the South three-quarters of said Blocks 115 and 11.6, McCrumments
Second Addition to the City of Lubbock, Lubbock County., Texas and does not, nor
is same intended to release the assessment lien as created by said Ordinance No.
812, aforesaid, on the North one-quarter of said Blacks 115 and 116, McCrummezts
Second Addition to the City of Lubbock, Lubbock County, Texas. That said assess-
ment lien as created by said Ordinance No. 812 remains in full force and effect
on the said Worth one-quarter of Blocks 115 and 116.
