HomeMy WebLinkAboutResolution - 111048C - Release Of Lien - Acuff Heights Addition, Lot 14 Block 14 - 11/10/1948RESOLUTION ViHEREAS,, onthe 28th day of December, 19381 the City Commission of the City of Lubbock in Regular Session at its regular meeting place in the City of Lubbock, passed an ordinance, same being Ordinance No. 6050 and, WHEREAS,, said ordinance levied and assessed for a part of the cost of im- proving a portion of Avenue "Im and sundry other streetsp avenues and alleys in the City of Lubbock and provided for the collection of such assessments and for the issuance of assignable certificates in evidence thereof upon certain property therein stated, and, TIMEASs on February 6, 1939, the City Commission of the City of Lubbock caused to be recorded in Volume 231, Page 105, Deed Records of Lubbock Countys Texas, a certain instrument, wherein said instrument showed that Lot l4, Block 14s Acuff Heights, an addition to the City of Lubbock, Lubbock County, Texas, was assessed its prorate portion of paving costs on said street, aforesaid, in the total amount of $283.67, and, TIREREAS, said description as contained therein was error, the correct des- cription being Lot 1I., Block 14, William Tubbs, an addition to the City of Lubbock, Lubbock County, Texas, and, WHEREAS.. said instrument as recorded, aforesaid,creates a cloud upon the title to said Lot 14, Block 1+4., Acuff Heights addition to the City of Lubbock, Lubbock County, Texas, and, MERLAS, the City of Lubbock is desirous of correcting and removing from said title said cloud af&resaid, as to Lot 14, Block 14, Acuff Heights Addition, THEREFORE, BE IT RESOLVED BY THE CITY COMIESSION OF THE CITY OF LUBBOCK: THAT, the Mayor of the City of Lubbock, BE, and he is hereby authorized to execute and deliver to the owners of Lot 14.. Block.14 Acuff Heights Additions a full and complete release as to said lien that was and might have been created by reason of said Ordinance No. 605: and the instrument recorded in Volume 231, Page 105s Deed Records of Lubbock'County, Texas.
