of the City, of Lubbock on August ll, 1949, filed in the Deed Records August 12,
1949, and recorded in Volume 393, Page 11 thereof, and Unit No. 921 was ineluded
in said ordinance for paving 33rd Street between the East porperty line of Van
Buren Avenue to the East property line of Tyler Avenue, and.,
MREAS, the City Limits line at the time of passage of said ordinance ran
rl�1'411t'e'.L"t- along the center line of 33rd Street between the East property line of Van Buren
air Avenue to the East property line of Tyler Avenue, by reason of which fact no lien
was created against the property in said unit lying on the South side of said
street and -said abutting property owners have refused to pay for paving on the
South side of said street and the City Commission finds that paving only the
f North side of said street in said unit will not be in the public interest and
the affected property owners desire a release from an apparent cloud on the
title to that part of 33rd Street described in Unit No. 921, THEREFORE,
BE IT RESOLVED BY THE CITY COTaAISSION OF THE CITY OF LUBBOCK:
THAT, W. H. Rodgers, Mayor of the City of Lubbockp BE, and he is hereby
authorized to execute a full and complete release on behalf of the City of
Lubbock releasing all property abutting 33rd Street between the East property
.• line of Van Buren Avenue and the East property line of Tyler Avenue as described
in Unit No. 921, under Ordinance No. 925, from any and all apparent liens that
may exist against said property by reason of such assessment provided in
Ordinance No. 925•
AND IT IS SO ORDERED.
Passed and approved by unanimous vote of the City Commission this the
