Resolution - 072849B - Sale Of Buildings - Municipal Airport - 07/28/1949
R E S O L U T I O N � 1� BE IT ,RESOLVED BY THE; CITY COMMISSION OF 'IRE CITY OF LUBBOCK,TEXAS: 4 THAT WHEREAS, on January 4, 19499 the United States Government did transfer to the City of Lubbock certain buildings anal/or improve- ments at the Lubbock Municipal. Airport for Airport revenue producing purposes, and WHEREAS, certain of these buildings and/or improvements had a pre-determined-economi a life of ninety (94) days, and WHEREAS, the aforesaid pre -determined economic life has passed and the buildings are deteriorating rapidly to the point where all value is being dissipated, and WHEREAS, the intent, spirit, and purpose of the aforesaid transfer of properties by the United States Government to the City of Lubbock was for the purpose of providing revenue to support a:. d maintain the. Lubbock Municipal Airport. Now, therefore, it is hereby determined by the City Commission of the City of Lubbock that the best interests of the. City of Lubbock, Lubbock Municipal Airport, and aviation as a whole will be served by the sale of these buildings, with all revenue derived therefrom to be placed in the Airport Revenue Account for the mainteng ce and/or improvement of the Lubbock Municipal Airport; And, the City Manager and the Airport Manager are hereby author- ized and directed to advertise the said buildings for sale immediately They are further directed to establish an inspection period whereby interested parties may inspect the buildings offered for sale. Said inspection period to be from August 8 through August 18, 19499 inclusive. They are further directed to receive sealed bids on these buildings until the close of business August 23, 1949. Said bids are to be publicly opened on Thursday, August 25, 1949, and an award made by the City Commission to the hied bidder. The City reserved the rigrit to reject any and all bids. ine terms and conditions of sale together with the list of buildings attached hereto are hereby made a part of this Resolution and shall be marked "Exhibit A". SEALED BIDS will be received until then publicly opened at the City Hall, Lubbock, Texas, for the sale and removal of certain buildings and fixtures located therein, exclud- ing personal property. LOCATION AND DESCFTPTiON 2, The property offered for sale hereunder is located at Lubbock Municipal Airport, Lubbock, Texas, end is more particularly described on the attached bid form. The descriptions end locations are believed to be correct, but any error or omission in the descrip- tion of the property shall not constitute any ground or reason for non- performance of the contract of sale or claim by the purchaser for any allowance, refund or deduction from the purchase price. The right is reserved to reject any and all bids, to waive any defect or informality in bids received, and to accept or reject any Ad or portion thereof. 4. This invitation, bid and acceptance by the City shall consti- tute the entire contract of sale between the successful bidder and the .ity. 5, Inspection of Buildinps. The buildings are, now subject to inspection -by prospective purchasers. Post Office Money Order, � yablc to the order of the City of Lubbock, and in an amount not less than 10 percent of the full amount )f the bid submitted except when the total amount is less than fifty %liars ($50.00), in which event the total amount bid shall be sub- iitted and provided that no deposit shall be submitted in excess of 42,500.00. The deposit of the successful bidder will be retained by `he City and applied as .part paytme,nt of the purchase price. Additional Deposit. In addition to the payments provided for seder Paragraph 7 hereof, the successful bidder shall, prior to the sward of the contract, be required to deliver to the City, for which it ,hall issue a receipt, a certified check, cashier's check or U. S. Post )ffice Money Order, drawn to the City of Lubbock for a sum determined is follows: Where the average sale price is less than two hundred dollars ($200.00) per building, a deposit of 20 percent of the average sale price of each building will be required. Where' the average sale price of a building is two hundred dollars (200.00) or in excess of that amount, a deposit of fif ty dollars (:, 50.00) per building will be required. his deposit is to be made to the City to insure the faithful perfo r- ance of the cantract. In the event the contract for sale and removal .s not performed to the complete satisfaction of the City, the build- .ngs, building fixtures or any portion thereof remaining shall be for- 'eited and the deposit and payments which have bean made ill be ,etained as liquidated damages. All buildings shall )e removed to the foundations but shall not include concrete floors on :he ground, foundations or subsurface utilities; underground facilities if the buildings purchased and di all be permanently capped in a manner satisfactory to the City. Time Limit on R(j.1oval of Buildin. s. The successful bidder hall complete the removal of the buildings or building and all clean - _p operations required by Paragraph 13 above within 60 days after the ailing date of the notice of acceptance of his bid.
