WHEREAS, the Governing Body of the City of Lubbock deems it advisable and in the public interest to contract for the exclusive privilege of salvaging the garbage dumps and sanitary fills of the I City,and, WHEREAS, it is deemed advisable to approve specifications and advertise for bids for the exclusive privilege of salvaging the garbage dumps and sanitary fills for the year beginning May 10 1949 and ending April 30, 19502 NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That the City Secretary be and she is hereby authori to advertise for bids to be received by her until 1:30 P.Ma April 140 1949. These bids shall be based on the attached copy of speci- f1cations which are hereby approved and will govern the salvage operations to be performed under the contract to be awarded. SECTION 2. This Resolution shall become effective from and after its passage and was unanimously passed by the City Commission upon motion of Commissioner Price and seconded by Commissioner .S'ni_kP_4' • A,TTES T : City ary i osi(P49A SPECIFICATIONS FOR SALVAGING THE GARBAGE DUMPS AND SANITARY FILLS OF THE CITY OF LUBBOCK Sealed bids will be received until one thirty o1clock (1:30) p.m., April 14, 1949, by the City Secretary of the City of Lubbock, Texas, for consideration by the City Com mission for the privilege of salvaging the garbage dumps and sanitary fills of the City of Lubbock under the following specifications. 1. The bidder to whom the contract may be awarded, hereinafter referred to as ncon- tractor", shall before submitting his proposal for the privilege of salvaging the garbage dumps and sanitary fills of the City of Lubbock, examine the premises and satisfy himself as to the existing conditions under which he will be obligated to operate in performing his part of the work, or that may in any manner affect the work covered by these specifications. 2. The contractor will be required to employ such means, methods, and equipment in carrying out the salvage operations on the garbage dump and sanitary fills of the city as will cause no -interruptions or interference in collection and disposal of gar- bage or waste. Salvage shall be carried on concurrently with dumping of truck and when salvage has been made the contractor shall shove or place garbage or waste into the ditch designated as the sanitary fill. He shall be privileged to salvage any or all materials or substances which he may find in the garbage dumps, but he shall not be allowed to salvage from the sanitary fill ditch. 3. The contractor shall furnish adequate supervision of salvaging operations on the dump grounds and sanitary fills. He shall direct the dumping of city and private owned vehicles in accordance with instructions issued by the Superintendent of the Garbage Department. The superintendent or representative of the contractor shall be approved by the Superintendent of the Garbage Division of the City of Lubbock. Upon written request of the Superintendent of the Garbage Division, the contractor, with- out cause, shall remove from the garbage dumps of the City of Lubbock any laborer or superintendent in his employ. /+. The contractor shall provide an adequate number of laborers to carry on the opera- tion at all times. The number of laborers shall be approved by the Superintendent of the Garbage Division. The contractor shall also submit the names of all his employees; and at any time a laborer or other employee is discharged or employed, the names of those affected shall be given to the Superintendent of the Garbage Division. In the absence of'the Superintendent of the Garbage Division, the list shall be given to or filed with the city employee operating the tractor, and known as the tractor operator; the contractor shall require all of his employees to wear at all times an identifying badge of approved design. It shall be mutually understood and agreed that an such laborers provided by the contractor shall be his employees and not those of the City of Lubbock. 5. The contractor shall handle all salvaged materials in such a manner as to prevent its blowing or scattering and shall remove such material from the dumps and sanitary fills by the end of each day. 6. The contractor shall provide and maintain his warehouse or storage facilities in such manner and condition as to prevent the harborage or breeding of rats. 7. The contract on which the bid is submitted shall be in effect and in force for a -2- oa1e49q period of twelve (12) months beginning May 1, 1949, and ending April 30, 1950, for exclusive privilege of salvaging all garbage dumps and sanitary fills, maintained or established by the City of Lubbock. 8. The contractor -shall make payment for salvaging privileges to the City of Lubbock in twelve (12) equal monthly payments, each to be paid on or before the first day of the month covered by such installment. 9. The contractor shall be required to furnish and maintain during the life of con- tract adequate Worinaens' Compensation Insurance covering all of his employees working on the garbage dumps of the City of Lubbock. 10. The contractor shall be responsible for all damage or injury to persons or property of any character occurring during the prosecution of the work, and resulting from any act, omission, neglect, or misconduct on his part, or that of his employees. He shall furnish to the City of Lubbock a good and sufficient surety bond in the amount of Twenty -Five Hundred ($2000.00) Dollars, made payable to the City of Lubbock, which bond shall hold the City safe and harmless from any and all damages occasioned by the performance of the contract. 11. A Cashier's Check in the amount of Two Hundred ($200.00) Dollars, payable with- out recourse to the order of the Mayor of the City of Lubbock, shall accompany each bid as a guaranty that if awarded the contract, the bidder will promptly enter into. a contract, and execute and furnish bond as hereinafter specified. 12. The contract shall be subject to cancellation upon ten (10) dayst notice to the salvage contractor for reasons of failures to pay the monthly charge, or failure on the part of the contractor to cooperate fully with the Superintendent of the Garbage Division with reference to time, place, and method of salvaging and maintenance of garbage dumps of the City of Lubbock. Furthermore, this contract shall be subject to cancellation by the City at its discretion upon thirty days written notice to the contractor. 13. The City of Lubbock reserves the right to reject any and all bids.
