SEAS, undei General Work Order No. 514 and in connection therewith, Ordinance
No. 953 was -.passed-,,77 tV the City Commission assessing property within units here-
inafter specified for paving and,
SEAS, each of said units incl{ide the paving of alleys where industrial rail-
road tracks are located, and,
WHEREAS, said contract was let to the Panhandle Construction Company by,contract
executed September 22, 19/+9'9 by the Panhandle Construction Company, and both the
Panhandle Construction Company and the City :of Lubbock mutually desire,,.. that said
units be deleted from said contract because an error was made in the original plans
for this work; ::.that:.'-: insofar as it affects the units hereinafter designated
which includes alleys in which railroad tracks are located, the error does.not show s
cross-section of the type construction to be used in such alleys, resulting in the
inability of the contractor to predetermine the cost involved,
NO.9 THEREFORE, BE IT RESOLVED BY THE CITY COMTISSION OF THE CITY OF LTJBBOCK:
That the City of Lubbock does hereby release the Panhandle Construction Com-
pany from its contract to pave the alleys in the following units established by the
Engineer's Roll. under General Work Order No. 514, and made a part of Ordinance No.
953, PROVIDED the Panhandle Construction Company execute a written release to the
City of Lubbock, relinquishing any and all claims against the -City of Lubbock which
may exist by reason of the abandonment of the paving in said units, and that said
Panhandle Construction Company forthwith release the abutting property affected by
the passage of the assessment Ordinance from any and all liens and claims of every
nature, resulting from the proceedings establishing such claims and liens, AND
FURTHER. PROVIDING that the deletion of these units and releasing the Panhandle
Construction Company from paving the alleys in said units, under the terms of its
contract with the City of Lubbock, shall never be construed as in any manner releas-
ing said Panhandle Construction Company, or otherwise in any manner modifying its
said contract to pave the alleys included within other units in this project, and
covered by said contract, and that the Bond executed by the Panhandle Construction
Company, dated September 22, 1949, with the Great American Indemnity Company as
Surety, shall remain in full force and effect.
