WHEREAS 'the City Cormission:on the 27th day of November, 10,50, authorized
a Right -of -Way Agent to hake an offer to Claude Tate. of 09,970.00, X2,720.00
of said anoint being for the moving of hog barns off the right-of-way, said bar
belonging to the lessee Eugene Wilson who had heretofore accepted said amount.
Said property of Claude Tatum being in the City of Lubbock., Lubbock County, Tex
fronting'on the test side of Avenue "An and further described as follows:
"The East 17.5 feet of Lots 11 through 20, Block- 189, Original Town,
of City of Lubbock, Lubbock_ County, Texas,"
MTD W11ERMS, on Decenber 4th and 9th, 1950, J. A. 14aynard, as Agent for the
City of Lubbock rade anoffer to Claude Tatum of 07,250.00 for a Right -of l:ay
Easement across said tract of land, and the said Claude Tatum refused to accept
such offer for the aforesaid tract of land, and the City C=ission considered
such offer to be fair and in all things reasonable and it appears that any fur-
ther effort to gree -with hin� would be futile, THEREFORE,
BE IT RESOLVED BY TEE CITY C011 ISNOT OF THE CITY OF LUBBOCK:
THAT the City Attorney be, and he is hereby authorized and directed, to
file condcrnation provedings against said tract of land described in the pre-
amble of this Resolution, against the said Claude Tatum and all other persons
having an interest in said property, the same being required for the opening,
extension and wicening of Avenue "An between 17th Street and Broadway.
On notion of Commissioner Thomas , seconded by Cormissi
Davis , the foregoing Resolution ua.s unamiously passed
by an affirnative vote of the City Comnlission this 213th day of June, 1951.
