Fanning - GWO 557 - 09/11/1952RESOLUTION RESOLUTION ACCEPTING IMPROVEMENTS ON PORTIONS OF STREETS, AMTDES, AND/OR ALLEYS, AS LISTED BELOW, AND ORDERING THE ISSUANCE OF •CERTIFICATES IN EVIDENCE OF THE ASSESS MEIiTS LEVIED. WHEREAS, the City of Lubbock heretofore passed various street improvement ordinances and resolutions, and entered into contract with J. R. Fanning (G.W.0. 557) for the making and construction of street improvements on portions of numerous streets, avenues, and/or alleys in said city including among others the following: Avenue "BA from its intersection with the South Property Line of Main Street to , its intersection with the North retaining wall of the Broadway underpass, known and designated as Unit No. 1062. Avenue "J" from its intersection with the South Paving Line of 3l+th Street to its intersection with the South Property Line of 36th Street,,known and designated as unit Nb. 1066, AND WHEREAS, the improvements upon the said portions of the abovementioned streets and avenues and/or alleys' have been completed and have been inspected and found to have been constructed in accordance with terms of said contract. THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS: That the improvements on said portions of the abovementioned streets, avenues and/or alleys be, and the same are hereby accepted. II. That the Fiayor and City Secretary be, and they are hereby instructed to execute and deliver certificates in evidence of the assessments levied against the arcels of property abutting upon the said portion of the streets, avenues and or alleys listed above and against the owners of such property in accordance with law and in the manner provided in said contract and the proceedings with reference to said improvements and assessments where such assessments were levied, and the City Engineer is hereby directed to write a letter releasing money held in escrow'to;be paid the contractor for improvements where the abutting property was not assessed.
