SUBJpECT TO 'FURTHER, ORDERS, OF THE CITY COMMISSION; MAKING PROVISIONS EFFECTIVE SEPTEMBER 1, 1952. WHEREAS, the franchise with the 'Lubbock Bus Company has been recently amended to permit the -City Commission within its discretion to increase adult fares to fifteen cents (15�), and after application duly made by said Bus Company to increase certain fares, the City Commission duly held,a public hearing thereon and after having :heard all presented evidence and testimony relating to protests, the value of .the franchise and earnings of said company, finds that said rates should be increased .as hereinafter specified, and due to operating losses of said company; and, WHEREAS, said company duly made its application to discontinue the service on the Avenue N and 38th Street line at 38th Street in which connec- tion the City Commission finis that patronage is inadequate to support the line and in addition thereto, ssie4treets are not paved; THEREFORE, BE IT.RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK- SECTION 1. That on and after the effective date of this Resolution, the following rates and charges shall apply to all transportation on buses operated by said franchise holder; Fifteen cents (15�) cash fare between termini, except as herein stated. Five cents (5�) cash fare for children attending schools of twelve (12) grades: or lower, for transportation to and from schools. In lieu of the fifteen cents (15�) cash fare between termini, the company is authorized to issue and sell transportation tokens at the rate of two (2) tokens for .twenty-five cents (25�,) and accept any such token in lieu of the fifteen cents (15�) cash fare. Five cents (5�) cash. fare at all times for children six (6) to twelve (12) years of age, inclusive. No charge for children five (5) years of age or under when accompanied by a Paying passenger. Transfers to be issued free of charge. The foregoing fares and provisions shall be continuously posted in each bus in a conspicuous place. SECTION 2. The foregoing change in the adult rate or charge is made !subject to the right reserved by the City Commission of the City of Lubbock to hereafter at any time it may deem it expedient or necessary in the public interest to reconsider or modify the said .rates by resolution and, after notice ^--, to :the franchise holder, should the CityCommission find such.reduction to be in the public interest. SECTION 3. The foregoing rates shall be effective for all schedules and buses operated on and after September -1, 1952, and until changed by the City Commission of the City of Lubbock. :SECTION 4. The application to discontinue service on the Avenue N and .38th.Street line at 38th.Street is denied. y SECTION 4A. The :Lubbock Bus Company is authorized to suspend opera- tion of bus service on the Avenue `N and '38th Street line at '38th Street until such time as the. City Commission may by its resolution .direct, with or without notice to the bus company, that service :on said line be reconsidered, such suspension to apply to service on said route as above specified on and after September 1, .1952. AND IT :IS 60 ORDERED. --On motion of Commissioner Carpenter seconded by.
