vnard of "REAS, heretofore the City of Lubbock, a Home Rule Municipal Corp-
nvn.,d� i oration, acting by and through its duly elected Payor, in accordance with
6-1-55 authority granted by a resolution of the City Commission of said City, ex-
ecuted and delivered to Lubbock Auto Company, a corporation, a certain
Quit Claim Deed dated the 12th -jay of Mair , 1955,
covering the following described real. estate situated in the County of
Lubbock, State of Texas, to -wit:
BEGINNING at the Southeast corner of Lot 13,
Block 14, Original Town, Lubbock County, Texas;
THENCE East a distance of 60.0 feet along the
projection of the North line of 5th Street to
a point;

TEMME; North 450 37' 45" West a distance of
85.80 feet to a point in the East line of Lot
15, Block 14, Original Town;
THENCE South along the East line,of Lots 15-14
and 13.. Block 142 Original Town, to the POINT
OF BEGINNING,
Containing 1839.9 square feet; and
WHE��EAS, the said City of Lubbock, acting by and through MURRELL R.
TRIPP, its duly elected and constituted Mayor, as authorized by an Ordi-
nance of the City Commission of said City, executed to Lubbock Auto Com-
pany, a corporation, a certain Warranty Deed dated the 27th day of
1955, covering the following described real estate
situated in the County of Lubbock, State of Texas, to wit:
BEGINNING at the Southeast corner of Lot 15,
Block 14, Original Town, Lubbock County, Texas;
THENCE North 9.33 feet along the East line of
Lot 15, Block 14, Original Town to a point;
THENCE North MP 371 45" West a distance of 86.09'
feet to a point in Lot 170 Block 14, Original Town,
') said point being 60.2 feet West and 7.13 feet South
of the Northeast corner of said Lot 17, Block 14,

THENCE Southeasterly a distance of 92.98 feet to
the Southeast corner of Lot 15, Block 3-4, Original
Town, to the PLACE OF BEGINNING:
WHEREAS, each of said Deeds contains the following language to -wit:
"save and except the exclusive rights of ingress and
egress, which are hereby reserved and retained by
the City of Lubbock"
in addition to other language, reference to said Deeds being here made; aiid,
WHEREAS, it was not the intention of the City of Lubbock to reserve
unto itself any rights of ingress and egress to or from the property con-
veyed by said Deeds, the only intention of the City being to require the
grantee in the said Deeds'to release and relinquish its rights of access
over and across the property conveyed to and from the abutting streets;
NOW, THEREFORE,
BE IT RESOLVED BY TIS CITY COITMISSIOU OF THE CITY OF LUB OCK:
SECTION 1. That the Honorable 11urrell R. Tripp, Mayor of said City,
BE and he is hereby authorized and directed to execute a release to Lubbock
Auto Company, releasing to said Lubbock Auto Company any right of ingress
and egress apparently reserved to said City in the Quit Claim Deed and the
Warranty Deed hereinabove referred to, and declaring the property conveyed
by said Quit Claim Deed and said Warranty Deed free and clear of any rights
of ingress and egress on the part of said City; provided, however, that
said release shall recite that nothing; therein contained shall be construed
as nullifying the prohibition contained in said Quit Claim Deed and said
Warranty Deed against access over or across the properties conveyed there-
by to or from the abutting streets, by grantee its successors or assigns.
BE IT FURTHM RESOLVED, that the City Secretary BE and she is hereby
authorized and directed to affix the seal .of said City to said release and
to attest the same.
On motion of Commissioner Carpenter , seconded by Commissioner
Baker r, the foregoing Resolution was approved and passed on
this 27th day of May , 1955, by the following vote:
Commissioners voting "YEA": Baker, Carpenter, Forrest and Mayor Tripp
Commissioners voting "NAY": None
