Maxey Company - Sewer Tile Deliveries - 11/08/195607, /^ R E S O L U T I O N WHEREAS, Mr. Homer; rt Maxey has raised sop4e question about the pay- ments made and to be made to Homer G. Maxey Company Incorporg1gi a Texas Corporation, due to the fact that Mr. Maxey is a commissioner at the present time when some of the payments are being made, the Commission has required and received a complete report and finds as follows: THAT, the pipe purchased was from the above mentioned Corporation unde3 date of September 14, 1955, Purchase Order No. A 8576 dated September 16, 1955, that the amount of the bid resulting from competitive bids was $29, 677.98 for 2, 413 lineal feet of 211, vertrified sewer the and 5,238 lineal feet of 241, vertrified sewer tile, and that the tale had'to be manufactured and delivery started six months from receipt of the purchase order. THAT the purchase was in all things regular and constituted a binding contract with the City of Lubbock. The purchase in fact having been made long before Mr. Maxey was elected City Commissioner, and, that no changes of .any character have been made. And it being the opinioncf the Commission and it so finds that said contract is in all things regular, that payment should be made for the tile as and when delivered according to the terms of the contract, THEREFOR BE IT RESOLVED BY THE CITY COMMISSION: THAT the contract and payments due thereon be considered and disposed f and consumated in the same manner as any other contract as and when the emaining deliveries of tile are made. On motion of Commissioner Byrd Seconded by Commissioner Case , , the foregoing Resolution was passed this 8th day—of Novemer, 1956, by the following vote: Commissioners voting aye - Byrd,.
