WMEAS:it is the desire of the City Council of the City of Lubbock to have the pavement widened to Sixtyy-eight(68')feet between curbs, from 26_tji Street t9 --Traffic Circ, a from to Length frgm to Length a distance of 12,000 feet, and as it is understood that the State Highway Commission Will provide the widened and if :the City will build the curb and gutter, NOW, THEREFORE, be it resolved by the,City Counpil, of the City of Lubbock in regular session this � G26th day of �` , 19_18 , that the Highway ;Department is hereby requested to widen and improve Highway 87 (Avenue H) as set out above, Old The City of Lubbock will provide all necessary right-of-way clear of ob- struction and free of property damage and tirtll provide for the immediate construe - tion of !,continuous curb and gutter, utility adjustments, storm sewers, etc.,, all as may be necessary for a complete project with the exception of pavement wideni.ngi and will assume responsibility for the construction of driveways and sidewalks should they be deemed necessary now or in the future. The Texas Highway Department' after the City had fulfilled its responsibilities, will provide for pavement widening and its support within these limits. It is understood that the responsibility of the Texas Highway Department is cony fined to the pavement and its support and all other features necessary now or in the future to provide an adequate travel facility shall be the responsibility of the City of Lubbock . It is further agreed.tIhAt the City of Lubbock will maintain that por- tion of'the work which is its construction responsibility and will pass such resol- utions and ordinances in accordance with standard forms of the Highway Department to indemnify the State during and after construction against arty and all liability or damages growing out of such construction, to regulate traffic, to 'provide for parallel, parking and to prevent encroachment on the right-of-way.
