WHEREAS, the City of Lubbock and the State of Texas, by and through
the State Highway Commission, h1:ve entered into a contract as mpowered
and authorized by Arta 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the Stateighway"
system, which has heretofore been designated as Loop 289 by th State High-
way Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisitior
of the necessary land needed for road right of way purposes is the obligation of th
City of Lubbock; and,
WHEREAS,. the State Highway Commission has deemed it necessary in orde
to make certain kghway improvements in connection with said 11 Loop 289" situate
in and adjacent to' the. City of Lubbock and to the end that thispu pose be accom-
plished, the necessity of which is hereby confirmed by the City commission of
the City of Lubbock, it is necessary that fee simple title to the land hereinafter
described be acquired by the City of Lubbock in fulfillment and satisfaction of
its contractual obligations to the State of Texas; and,
WHEREAS, ALTOX C. TANNER and MARY EDNA TANN

Being a part of Tract 6,, of the S. I. .Johnson Sub -division in Section
3, Block S, G. C. & RR Go. Survey as shown by a plat reorded in
vol. 59, page 354 in the deed records of Lubbock County, Texas, and
being more particularly described as follows:
BEGINNING at a point in the East line of Tract 6, said point is South
89018t West, 1055.6 feet and South 00421 East, 833.7 feet from the
Northeast corner of Section 3;
THENCE South 00421 East, 301.2 feet to a point in acurve,' said pant
is South 5i0411 East, 3969.83 feet from the center of said c�rve;
THENCE Westerly along said curve to the right, a distance of
346.4 feet;
THENCE South 890191 West, 2294.0 feet to a point in the West line
of Tract 6
THENCE North 0042tWest, 300 feet;
THENCE North 890j9t East, 2294 feet to a point in a curve, Isaid
P&t is ,South. 0041, Last, 3669. 83 feet from the center of said curve;
THENCE Easterly along said curve to the left, a distance of 346.5 feet
to the PLACE OF BEGINNING and contains 18.183 acres.
THAT the owners of said land be offered, through the Right of Way Depart-
ment, the :amount appraised as the value and tO, al.,44mage s for the fee: -simple
title and acquisition of said land for the purposes,be,rein stated, for the�use and
benefit of the City of Lubbock and 'State of Texas, and unless accepted forthwith
the City Attorney is hereby authorized and instructed to institute condemnation
proceedings to acquire the fee simple title to said land as hereinabove described
for highway purposes.
