WHEREAS,, the City .of Lubbock has heretofore entered into an agmee-nent
with the Texas. Highway Department for procurement of Right-of-way on the
following projects: (l) Loop 28.9, Project No. RW -7.83-1-2,, from U. S. Highway

91 62, Northeast of Lubbock= to Quirt Avenue, Southeast of Lubbock.,. agreement
1 dated July 31, 1957; and (2) Loop 28.9, project No. RW -X783-2-2, from U. S. High-
i! way ;.;84, Northwest of Lubbock* to U. S. Highway 6_2, North east of Lubbock.,
i agreement dated July 31, 1957; and.,
. WHEREAS,* the Texas Highway Department and the City of Lubbock desire to
xeplace said prior contractual agreements by entering into the present contract
in order to effectuate certain recent changes in policy pronounced by the State
4�+ Highway Commission which will be mutually beneficial to both the State of Texas ai
! the City of Lubbock, in that such new agreement provides simplified procedures
for the final billing for fencing and utility adjustments, :NOW THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and he is hereby authorized and
directed to execute for and on behalf of the City of Lubbock the attached five copiee
of Contractual agreement for Right-of-way Procurement, Texas Highway Depart-
jmeat Right -of -Way Division Form D-15-39: between the State of Texas, acting by
and:through the Texas Highway Department* and the City of Lubbock, concerning
the following projects: (1) Loop "289, from U. S. Highway 62* Northeast of
Lubbock, to Quirt Avenue, Southeast of Lubbock? Project No. RWY-783-1-2; and
(2) Loop 289, from U. S. Highway 84, Northwest of Lubbock, to U. S. Highway

IThe City Secretary is authorized and directed to attest the five copies of said
agreement and affix thereto the :seal of the City of Lubbock, and when duly execute(
to attach to each copy thereof an authenticated copy of this Resolution and deliver
all of same to the Right-of-way Department of the City of Lubbock for such further
i' action as necessary.
