RESOLUTION CANVASSING RETURNS AND DECLARING
RESULT OF ELECTION
THE STATE OF TEXAS
CITY OF LUBBOCK
COUNTY OF LUBBOCK
ON THIS the '11th day of September, 1959, the City
Commission of the City of Lubbock, Texas, convened in Recessed"Regui
session, at the regular meeting place thereof in the City Hall,
there being present and in attendance the following members:
LENNIS W. BAKER, MAYOR
VERNON E. THOMPSON
OTIS MANER COMMISSIONERS
HOMER G. MAXEY
and
MRS. LAVENIA LOWE, CITY SECRETARY
also being present; and with the following absent: David C. Casey
constituting a quorum; at which time
the following, among.oth er business, was transacted, to -wit:
Mayor Baker introduced a resolution canvassing returns
and declaring result of an election held in the City of Lubbock,
Texas, on September 10, 1959.
Commissioner Maxey made a motion that any
rule requiring that resolutions be not finally passed on the
day introduced, but must be passed, read and voted upon more than
one time or at more than one meeting of the City Commission, be
suspended for the reasons stated in the emergency clause.
The motion was seconded by Commissioner Maner
and carried by the following vote:
YEAS: Mayor Baker and Commissioners Thompson,
Maner and ftsey.
NAYS: None.
Thereupon, Commissioner Thompson moved that
the resolution canvassing returns and declaring result of the
election be adopted The motion was seconded by Commissioner
Maxey
The motion, carrying with it the passage and adoption
of the resolution prevailed by the following vote:
YEAS: Mayor Baker and Commissioners Thompson,
Maner and Casey.
NAYS: None.
The RESOLUTION is as follows:
WHEREAS, under and by virtue of a resolution and order
duly passed by the City Commission of the City of Lubbock, Texas,
on the 13th day of August, 1959, an election was held in said
City on the 10th day of September, 1959, on eleven propositions
for the issuance of the bonds of said City of Lubbock, Texas,
in the following amounts and for the following purposes, to -wit:
$1,713,000
general obligation bonds for the purpose
of making permanent public improvements,
to -wit: constructing, enlarging, altering,
repairing and equipping the municipal
building in and for said City to house City
offices, Corporation Court and Police
Station;
$4,000,000
general obligation bonds for the purpose of
making permanent public improvements, to -wit:
constructing improvements and extensions to
the City's Waterworks System;
$11100,000
general obligation bonds for the purpose of
making permanent public improvements, to -wit:
constructing improvements and extensions to
the City's Sanitary Sewer System;
$1,2001000
general obligation bonds for the purpose of
making permanent public improvements, to -wit:
constructing street improvements for said
City, including acquisition of rights-of-way;
$ 600,000
general obligation bonds for the purpose of
making permanent public improvements, to -wit:
purchasing and/or improving lands for public
parks in and for said City;

$ 500,000 general obligation bonds for the purpose of
making permanent public improvements, to -wit:
the purchasing, constructing and installing
of street lighting in and for said City;
$ 800,000 general obligation bonds for the purpose of
making permanent public improvements, to -wits
the purchasing, constructing and installing
of traffic signals in and for said City;
$ 400,000 general obligation bonds for the purpose of
making permanent public improvements, to -wit:
constructing and equipping a fire station
building in and for said City;
$ 1202000 general obligation bonds for the purpose of
making permanent public improvements, to -wit:
constructing, enlarging, extending and instal-
ling storm sewers, drains, and gutters, and
other improvements incidental thereto in and
for said City;
$ 50,000 general obligation bonds for the purpose of
making permanent public improvements, to -wit:
enlarging, repairing and equipping the
municipal warehouse building in and for said
City;
$ 137,000 general obligation bonds for the purpose of
making permanent public improvements, to -wit:
constructing and equipping a street and water
department maintenance and equipment storage
building in and for said City.

AND WHEREAS, on this the 11th day of September, 1959,
same being a Recessed RegAar session of the City Commission,
there came on to be considered the returns of said election;
and,
WHEREAS, upon consideration of the returns of said
election, it appears that the same was in all respects legally
held, after due notice had been given, and that the said returns
were duly and legally made; and,
WHEREAS, it further appeFA from said returns that
there were cast at said election 5537 votes on the proposi-
tion for the issuance of $1,713,000 Municipal Building Bonds,
of which number 3 093 votes were cast "FOR THE ISSUANCE OF
$1,711,000 MUNICIPAL BUILDING BONDS AND THE LEVY OF A TAX IN
PAYMENT THEREOF"; and 1634 votes were cast "AGAINST THE
ISSUANCE OF $1,713,000 MUNICIPAL BUILDING BONDS AND THE LEVY
OF A TAX IN PAYMENT THEREOF"; and,

WHEREAS, it further appears from said returns that
there were cast.at said election ,5495 votes on the proposi-
tion for the issuance of $4,000,000 Waterworks System Bonds,
of which number 4537 votes were cast "FOR THE ISSUANCE OF
$4,000,OOO WATERWORKS SYSTEM BONDS AND THE LEVY OF A TAX IN
PAYMENT THEREOF"; and 95$` votes were cast "AGAINST THE
ISSUANCE OF $4,000,000 WATERWORKS SYSTEM BONDS AND THE LEVY
OF A TAX IN PAYMENT THEREOF"; and,
WHEREAS, it further appears from said returns that
there were cast at said election 5519 votes on the proposi-
tion for the issuance of $1,100,000 Sanitary Sewer System Bonds,
of which number 4593 votes were cast "FOR THE ISSUANCE OF
$1,100,000 SANITARY SEWER SYSTEM BONDS AND THE LEVY OF A TAX
IN PAYMENT THEREOF"; and 926 votes were cast "AGAINST THE
ISSUANCE OF $1,100,000 SANITARY SEWER SYSTEM BONDS AND THE
LEVY OF A TAX IN PAYMENT THEREOF"; and,
WHEREAS, it further appears from said returnq that
there were cast at said elect:,on 5553 votes on the proposi-
tion for the issuance of $3,200,000 Street Improvement Bonds,
of which number 410 Y votes were cast "FOR THE ISSUANCE OF
$3,200,000 STREET IMPROVEMENT BONDS AND THE LEVY OF A TAX IN
PAYMENT THEREOF"; and '1448 votes were cast "AGAINST THE
ISSUANCE OF $3,200,000 STREET IMPROVEMENT BONDS AND THE LEVY
OF A TAX IN PAYMENT THEREOF"; and,
WHEREAS, it further appears from said returns that
there were cast at said election 5516 votes on the proposi-
tion for the issuance of $600,000 Park Bonds, of which number
4234 votes were cast "FOR THE ISSUANCE OF $600,000 PARK
BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF"; and 1282
votes were cast "AGAINST THE ISSUANCE OF $600,000 PARK BONDS
AND THE .LEVY OF A TAX IN PAYMENT THEREOF"; and,

WHEREAS, it further appears from said returns that
there were cast at said election 5506 votes on the proposi-
tion for the issuance of $500,000 Street Lighting Bonds, of
which number 4359 votes were cast "FOR THE ISSUANCE OF
$500,000 STREET LIGHTING BONDS AND THE LEVY OF A TAX IN PAY-
MENT THEREOF"; and 1147 votes were cast "AGAINST THE
ISSUANCE OF $500,000 STREET LIGHTING BONDS AND THE LEVY OF
A TAX IN PAYMENT THEREOF"; and,
WHEREAS, it further appears from said returns that
there were cast at said election 5495 votes on the proposi-
tion for the issuance of $800000 Traffic Signal Bonds, of
which number 4455votes were cast "FOR, THE ISSUANCE OF
$80,000 TRAFFIC SIGNAL BONDS AND THE LEVY OF A TAX IN PAYMENT
THEREOF"; and 1040 votes were cast "AGAINST THE ISSUANCE OF
$80,000 TRAFFIC SIGNAL BONDS AND THE LEVY OF A TAX IN PAYMENT
THEREOF"; and,
WHEREAS, it further appears from said returns that
there were cast at said election 5537 votes on the proposi-
tion for the issuance of $400,000 Fire Station Bonds, of which
number 4695 votes were cast "FOR THE ISSUANCE OF $400, 000
FIRE STATION BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF
and 1442 votes were cast "AGAINST THE ISSUANCE OF $400,000
FIRE STATION BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF";

WHEREAS, it further appears from said returns that
there were cast at said election 5497 votes on theproposi-
tion for the issuance of $1200000 Storm Sewer Bonds, of which
number 448 votes were cast"FOR THE ISSUANCE OF $120,000
STORM SEWER BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF";
and 1014 votes were cast "AGAINST.THE ISSUANCE OF $120,000
STORM SEWER BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF";
and,

WHEREAS, it further appears from said, returns that
there were cast at said election 5512 votes on the proposi-
tion for the issuance of $50,000 Municipal Warehouse Bonds,
of which number 4207 votes were cast "FOR THE ISSUANCE OF
$50,000 MUNICIPAL WAREHOUSE BONDS AND THE LEVY OF A TAX IN
PAYMENT THEREOF"; and 1305 votes were cast "AGAINST THE
ISSUANCE OF $50,000 MUNICIPAL WAREHOUSE BONDS AND THE LEVY
OF A TAX IN PAYMENT THEREOF"; and,
WHEREAS, it further appears from said returns that
there were cast at said election 5332 votes on the proposi-
tion for the issuance of $137,000 Maintenance and Equipment
Storage Building Bonds, of which number4067 votes were cast
"FOR THE ISSUANCE OF $137,000 MAINTENANCE AND EQUIPMENT STORAGE
BUILDING BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF"; and
1265 votes were cast "AGAINST THE ISSUANCE OF $137,000
MAINTENANCE AND EQUIPMENT STORAGE BUILDING BONDS AND THE LEVY
OF A TAX IN PAYMENT THEREOF"; therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF LUBBOCK:
SECTION 1: That the aforesaid election was duly and
legally called and notice thereof given in accordance with the
laws of the State of Texas and the resolution and order calling
said election; that said election was held in strict conformity
with the Constitution and laws of the State of Texas, and the
returns thereof have been properly made to the officials of the
City entitled to receive same; that only resident qualified
property taxpaying electors of the said City of Lubbock, Texas,
who owned property therein, subject to taxation, and who have
duly rendered the same for taxation, were permitted to vote at
said election; and, further that said election properly represents
the desires of those qualified to vote as aforesaid.

SECTION 2: That the proposition to issue the
$1,713,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: constructing, enlarg-
Ing, altering, repairing and equipping the municipal building
in and for said City to house City offices, Corporation Court
and Police Station, was sustained by a majority of the quali-
fied electors of said City, voting at said election, who own
taxable property in said City, and who had duly rendered the
same for taxation, and that the City Commission of said City
is authorized to issue said bonds and to levy and have asses-
sed and collected taxes for the payment of the principal of and
interest on said bonds in the time and manner prescribed by law.
SECTION 3: That the proposition to issue the
$4,000,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: constructing improvements
and extensions to the City's Waterworks System, was sustained
by a majority ofthe qualified electors of said City, voting at
said election, who own taxable property in said City, and who
had duly rendered the same for taxation, and that the City
Commission of said City is authorized to issue said bonds and
to levy and have assessed and collected taxes for the payment
of the principal of and interest on said bonds in the time and
manner prescribed by law.
SECTION 4: ' That the proposition to issue the
$1,100,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: constructing improve-
ments and extensions to the City's Sanitary Sewer System, was
sustained by a majority of the qualified electors of said City,
voting at said election, who own taxable property in said City,
and who had duly rendered the same for taxation, and that the

City Commission of said City is authorized to issue said bonds
and to levy and have assessed and collected taxes for the pay-
ment of the principal of and interest on said bonds in the time
and manner prescribed by law.
SECTION 5: That the proposition to issue the
$3,2000000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: constructing street
improvements for said City, including acquisition of rights-
of-way, was sustained by a majority of the qualified electors
of said City, voting at said election, who own taxable property
in said City, and who had duly rendered the same for taxation,
and that the City Commission of said City is authorized to issue
said bonds and to levy and have assessed and collected taxes
for the payment of the principal of and interest on said bonds
in the time and manner prescribed by law.
SECTION 6: That the proposition to issue the
$600,000
general obligation bonds for the purpose of making
permanent public improvements, to -wit: purchasing and/or
improving lands for public parks in and for said City, was
sustained by a majority of the qualified electors of said City,
voting at said election, who own taxable property in said City,
and who had duly rendered the same for taxation, and that the
City Commission of said City is authorized to issue said bonds
and to levy and have assessed and collected taxes for the pay-
ment of the principal of and interest on said bonds in the time
and manner prescribed by law.
SECTION 7: That the proposition to issue the
$500,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: the purchasing, construct-
ing and installing of street lighting in and for said City, was
sustained by a majority of the qualified electors of said City,
voting at said election, who own taxable property in said City,
and who had duly rendered the same for taxation, and that the
City Commission of said,City is authorized to issue said bonds
and to levy and have assessed and collected taxes for the pay-
ment of the principal of and interest on said bonds in the time
and manner prescribed by law.
SECTION 8: That the proposition to issue the
$80,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: the purchasing,
constructing and installing of traffic signals in and for said
City, was sustained by a majority of the qualified electors of
said City, voting at said election, who own taxable property
in said City, and who had duly rendered the same for taxation,
and that the City Commission of said City is authorized to issue
said bonds and to levy and have assessed and collected taxes for
the payment of the principal of and interest on said bonds in
the time and manner prescribed by law.
SECTION 9: That the proposition to issue the
$400,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: constructing and equip-
ping a fire station building in and for said City, was sustained
by a majority of the qualified electors of said City, voting at
said election, who own taxable property in said City, and who
had duly rendered the same for taxation, and that the City
Commission of said City is authorized to issue said bonds and
to levy and have assessed and collected taxes for the payment
of the principal of and interest on said bonds in the time and
manner prescribed by law.
SECTION 10: That the proposition to issue the
$120,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: constructing, enlarging,

extending and installing storm sewers, drains, and gutters,
and other improvements incidental thereto in and for said
City, was sustained by a majority of the qualified electors
of said City, voting at said election, who own taxable
property in said City, and who had duly rendered the same for
taxation, and that the City Commission of said City is authoriz-
ed to issue said bonds and to levy and have assessed and correct-
ed taxes for the payment of the principal of and interest on said
bonds in the time and manner prescribed by law.
SECTION 11: That the proposition to issue the
$50,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: enlarging, repairing and
equipping the municipal warehouse building in and for said City,
was sustained by a majority of the qualified electors of said
City, voting at said election, who own taxable property in said
City, and who had duly rendered the same for taxation, and that
the City Commission of said City is authorized to issue said
bonds and to levy and have assessed and collected taxes for the
payment of the principal of and interest on said bonds in the
time and manner prescribed by law.
SECTION 12: That the proposition to issue the
$137,000 general obligation bonds for the purpose of making
permanent public improvements, to -wit: constructing and equip-
ping a street and water department maintenance and equipment
storage building in and for said City, was sustained by a major-
ity of the qualified electors of said City, voting at said
election, who own taxable property in said City, and who had
duly rendered the same for taxation, and that the City Commission
of said City is authorized to issue said bonds and to levy and
have assessed and collected taxes for the payment of the princi-
pal of and interest on said bonds in the time and manner
prescribed by law.
SECTION 13: The public importance of this measure
and the fact that it is to the best interest of the City of
Lubbock to construct the improvements hereinabove set out,
at the earliest possible date, for the immediate preservation
of the public peace, property, health and safety of the
citizens of said City, constitute and create an emergency and
an urgent public necessity requiring that this resolution be
passed and take effect as an emergency measure, and that this
resolution is accordingly passed as an emergency measure and
shall take effect and be in force immediately from and after
its passage, and it is so resolved
PASSED AND APPROVED, this the 11th day of
September, 1959.
