WHEREAS, the City of Lubbock and the State of Texas, by and through.
the State Highway Commission, hlave'entered into a .contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance oft0vtVI-9
artof the State Highway
system, which has heretofore been designated as8°1y the State High-
way Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisiti
of the necessary land needed for road right of way purposes is the obligation of
City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it t1g1,,safX.LJp order
to make certain Nghway improvements in connection with said "Loop 289" situatec
in and adjacent to' the City of Lubbock and to the end. that this purpose be accom-
plished, the necessity of which is hereby confirmed by the City Commission of
the City of Lubbock, it is necessary' that fee simple title to the land hereinafter
described be acquired by the City of Lubbock in fulfillment and satisfaction of
its contractual .obligations to the State of Texas; and,

for the fee simple title to said land have been appraised in the amount of

IBE IT RESOLVED BY THE CITY COMMISSION OF THE CI -TY OF LUBBOCK:'
THAT the fee simple title to the following described land situated !in Lub-
bock County, Texas, be acquired by the City of Lubbock for and on behalf of
he State of Texas for the purpose of opening, constructing and fnaintaining in
conjunction with the State Highway Commission, said "�s a designated
art of the State Highway System,, which land is more particularly described

0.122 of one acre of land, being a strip of land 10 feet in width lying parcel:
to the present right-of-way line extending from the east property line to the
west property line and being a p;�rt of Lots 1 thru 10, Block 1, Burleson & Osl
Heights Addition to the City of Lubbock, Texas, according to a plat recorded
Vol. 325, page 293, Deed Records of Lubbock County, Texas, which Lots 1 thru
Block 1, were conveyed to M.L. Gardner by a deed ds,ted 16 Dec. 147, and 30 No'
48, of record in vols. 349, page 124, and vol. 385, page 526, Deed Records
of Lubbock County, Texas, Which 0.122 of one acre is more particularly descril
by metes and bounds as follows:

benefit of the 'City of Lubbock and 'State of Texas, and unless accepted forthwith
the City Attorney is hereby authorized and instructed to institute condemnation
proceedings to acquire the fee simple title tVsaid land as hereinabove described
for highway purposes.
Approved and passed by unanimous vote of the Commission this 10th
