Caudle - Section 6 Block E - 07/23/1959RESOLUTION WHEREAS, :the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a icontract as empowered and authorized by ;,girt. 667$-b, Vernon's Annotated''Civil Statutes, providing for the location, construction and maintenance of that part of the State Highwayl system, which has :heretofore .been designated as Loop '289 by the State High- way Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has, deemed it necessary in orde. to make certain h ghway improvements in connection with said "Loop 289" situate in and adjacent to the. City of Lubbock and to the end' that this purpose be accom- plished, the necessity of which is hereby confirmed !by the City Commission of, the City of Lubbock, it is necessary that fee simple jtitle to the lend hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to4he State of Texas; and; WHEREAS , L: G: CAUDLE & WIFE, THEIMA own ;or :have some character inter sf.inAand needed for the location,: construction and maintenance of said Loop 289, and the value and total damagee'to the owners for -the fee simple title to said land have, been appraised in the amount of $Ni p �_ ` and the Commission finds aid amount to be fair and equitable; .NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:' THAT the fee simple title to the following described land situated;in Lub- bock County, Texas,. be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said "Loop 289" as a designated .part of the State Highway System, which land is more particularly described as follows: I' TWO parcels of land out of the northeast one-quarter of Section 6, Block E, conveyed to L. G. Caudle by deed dated 19 Feb., '46, and is recorded in vol. 318, page 292 of the deed records of Lubbock County, Texas, aid being more particularly described as follows: BEGINNING at a point in the South boundary line of the Bedritpk Bartos tract, said point being 986. 0 feet South and 236. 5 feet 'West 6f the Northeast corner of said section; THENCE South 340571 West, 152.6!feet along a line parallel to and 50 feet Southeasterly from the centerline of the proposed relocated Quirt Avenue as a stabli'shed in the field by the Texas Highway Department, to a poin � in the North boundary line of the Denman tract in said, section; THENCESouth 89057t West, 122. 1 feet along said North boundary line, to a point 2.8 feet Eat of the Northwest corner of said Denman tract; THENCE North 34057' East; 152. 6feet along a line 'parallel to and 50 feet Northvwe'sterly from said centerline 0 win to a pDint in the said South boundary line of the Barto s tract; THENCE North .890571 East, 122. 1 feet along said_South boundary line to the PLACE OF BEGINNINGS and contains 0.350 acres. BEGINNING at a point in the East boundary line of said section$ said point being 1595.4 feet ;South of the Northeast corner of said Section, said point being the Northeast corner of a certain tract of land conveyed by L. G. Caudle to the State of Texas by deed dated June 6, 156, and recorded in vol. 623, page 141. of the deed records of Lubbock County, Texas; 2HEKCE North 73037= West, 186.4 feet along the North boundary line of said State tract, to the beginning of a curve; THENCE in a Northwesterly direction along a circular curve to the right, the center .of the curve being North 16°231 East, 5614. 6 feet from the beginning of the curve, a distance of 40. 1 feet to a point in the East boundary line of the Denman tract in said section; THENCENorth 00031 West, '109. 5 feet along said East boundary line to a point on a curve; THENCE in a Northeasterly direction along a circular curve to the left, the center of the curve being North 0048t West," 1111.28 feet from the beginning of the curve, a distance of 219.4 feet to a point in the East boundary line of said section; THENCE South 00031 East, 198.2 feet along said East -boundary line to the PLACE. OF BEGINNING and contains 0.751 acres for &:'total area being conveyed .by this ixstrumen.t of 1.;' 101 acres. THAT the owners of said land be offered, throu&jhe Right of Way Depart- ment, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit`of the City of Lubbock and 'State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
