Best Scan Available - 01/22/1959f RESOLUTION WHEREAS, the City of Lubbock on the 14th day of June, 1956, entered into a lease; agreement with Lubbock Teenage Park, Inc., sometimes known and represented to be Lubbock Teenage, Inc., with W E. Medlock, president and Richard Dickey, secretary, and in truth and in fact said lease was made with the Lubbock Teenage and Lubbock Teenage Park and intended to be made to the corporation of which W. E. Medlock was president and Richard Dickey was vice- president, a copy of which lease is hereto attached and marked Ex. "A", and on which land therein described said corporation was to operate a drag strip; and, WHEREAS, the Board of Directors of said corporation, with. W. E. Medlock, President, on January 14, 1959, did hold a meeting at which said corporation and its directors abandoned the lease contract and use next.above mentioned, as show by the minutes thereof, an executed copy of which minutes are hereto attached an( marked Ex. "BIT; and, WHEREAS, pursuant the:re.16 said corporation executed an abandonment of said lease and 1tr eredthe same to the City of Lubbock for its acceptance as shown by an instrument attached hereto and marked Ex. TICS', which refers -to the lease agreement dated June 14, 1956, and the said 129 acres of land described in said lease; and, WHEREAS, said minutes provide that Mr. Medlock was empowered to abando the lease above referreckato conditioned upon a commitment of $1, 000 from Hillcre Country Club to apply on a note executed by certain persons in an effort to finance the drag strip operation, said note being payable'to the Lubbock National Bank; and, ' WHEREAS, the Hillcrest Country q$ab by its president, S. W. Noble and Chauncey Trout, secretary by letter dated January 16, 1959, a true copy of which is attached hereto and marked Ex. I'D", did make the required commitment on behalf of the Hillcrest Country Club contingent upon cancellation of the lease and termination of the drag strip operation, and the strip itself plowed up and rendere impossible for use as,a drag strip, said money to be paid as provided in Ex. I'D" when such condtions' have been met; and, WHEREAS, the Lubbock National Bank by its letter dated January 20, 1959, from John E. Key, Vice -President of said Bank, addressed to Vaughn E. Wilson, City Attorney of Lubbock, said letter being attached hereto and marked Ex. "E", did advise the City that if the lease contract entered into between the City and Lubbock Teenage Park, Inc., is cancelled, the 'Lubbock National Bank will not to to the City of Lubbock for payment of the note mentioned in said letter; and, WHEREAS, the City Commission finds that Lubbock Teenage Park, Inc., has abandoned the purpose of the lease, that the drag strip is being used without super vision by many unauthorized persons, and uses are being made of the leased property and the drag strip which indangered both persons and property, and the dust, c4oise and general disturbance resulting from the uncontrolled use of the land ana drag strip constitutes nuisance conditions in the area, which under the circumstances, should be abated by plowing up the drag strip and otherwise render ing the 'same unusable as a drag strip, in the public interest, NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT in the consideration of the premises the City of Lubbock reby accepts the instrument attached hereto and marked Ex. "C" and entitled +irelease of leases*, accepts possession of said land described in Ex. "A" entitled "lease agreement", and hereby terminates and cancels said lease marked Ex. "A and, SECTION 2. THAT the drag strip be forthwith plowed up and rendered impossible for use as a drag strip, SECTION 3. And, the Chief of Police is hereby authorized and directed to preserve order and the peace on the land described in Ex. I'A" on which the drag strip is located, and the use of any part of said land for drag strip purposes or racing purposes, or for other private purposes, is hereby prohibited until express authorized by the City of Lubbock. The City Secretary is directed to notify Mr. John. Key, Vice -President of the Lubbock National Bank of the passage of this Resol' tion, terminating and cancelling the lease, and to 'notify Mr. Steve Noble, President and Mr. Chauncey Trout, Secretary, of the Hillcrest Country Club, whe the drb.g strip itself has been plowed up and rendered impossible for use as a drag strip,; and also that the lease has been, turned backto.a.nd accepted and terminated and cancelled, by the City, of Lubbock.
