Jarrett Subdivision - 01/08/1959- ■ F OS:wc RESOLUTION WHEREAS, THE City of Lubbock and the State of Texas, by and through the Sta Highway Commission, have entered'into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, oon - struction and maintenance of that part of the State Highway system, which has hero tof ore been designated as U.S. Highway 62, commonly known and designated as th+ Brownfield Highway and Project No. 380-1-13 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City bf Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said U.S. Hghway 62, commonly known and designated as the Brownfield Highway and Project No. 380- 1-13 situated in and adjacent to the City of Lubbock and to the end that this pur- pose be accomplished, the necessity of which is hereby confirmed by the City Commission of.the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Tex as; and, 7 WHEREAS, D. F. LAMB and DELLA LAMB and UNITED FIDELITY LIFE INSURANCE CO. owns or has some character interest in land needed for the loca tion, construction and maintenance of U.S. Highway 62, commonly known and designated as the Brownfield Highway and. Project No. 380-1-13, and the value and total damages to the owners for the feesimple title to said land have been appraised in the amount of $910. 00 and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT, the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in 'conjunction with the State Highway Commission, said U.S. Highway 62, commonly known and designated as the Brownfield Highway and Project No. 380-1-13 as a designated part of the State Highway System, which land is more particularly described as follows: 0. 034 of one acre of land, same being a strip 10 feet in width lying parallel and adjacent to the present highway right-of-way line and extending from the West to the Ea st :boundary lines of the Lamb tract, said Lamb tract being out of and a, part of Block 5, John W. Jarrett Sub -division to the City of Lubbock, according to a plat of said sub- division, being of record in Volume 91, page 112, Deed Records of Lubbock County, Texas, which tract was conveyed to D. F. Lamb by deed dated June 9, 1953, of record in Volume 502, page 589, Deed Records of Lubbock County, Texas, and which 0. 034 of one acre is more particularly described by metes and bounds as follows: BEGINNING at the Northwest corner of said Lamb tract, being also the intersection of the.. West boundary line of said Block 5 and the present Southeast highway right-of-way line; THENCE North 530561 East, 150 feet along said Southeast highway �-/ right-of-way line to the Northeast corner of said Lamb tract; THENCE Southeasterly 1 1. 9 feet along the East boundary line of said Lamb tract, being also the West boundary line of the Waddington tract in Block 5; THENCE South 530561 West, 152.4 feet along a line parallel to and 10 feet Southeasterly from the said present right-of-way line, to a point in the West boundary line of said Lamb tract; THENCE North 12.4 feet along.said West boundary line to the PLACE OF BEGINNING. j THAT the owners bf said land be offered, through the Right of Way Depart- ment, the amount appraised as the value .and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title .to said land as hereinabove described for highway purposes. r Approved and passed by unanimous vote of the Commission this 8th day of Januar* 19 59 1. •n, ►vlVl►7 rsH.tstt, Mayor ATTEST:/"'-)pproved Laveni4 Lowe, City Gecretar-Treasurer
