WHEREAS,, the City of Lubbock and the State of Texas, by and through the
State Highway Commission, have entered into a contract as empowered and auth-
orized by Art. 6673-b,, Vernon's Annotated Civil Statutes,, providing for the loca-
tio% construction and maintenance of that part of the State Highway system, whic
has heretofore been designated as U.S. Highway 62,, commonly known and desig-
nated as the Brownfield Highway and Project No. 380-1-13 by the State Highway
Commission; and,
WHEREAS., under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation of the
City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in orde
to make certain highway improvements in connection with said U.S. Highway 6Z.,
commonly known and designated as the Brownfield Highway and Project No.
380-1-13 situated in and adjacent to the City of Lubbock and to the end that this
purpose be accomplishe4 the necessity of which is hereby confirmed by the City
Commission of the City of Lubbock, it is necessary that fee simple title to the
land hereinafter described be acquired by the City of Lubbock in fulfillment and
satisfaction of its contractual obligations to the State of Texas; and,
WHEREAS, J.K. WADDINGTON and wife, ROSA WADDINGTON own or have
some character interest in land needed forthelocation, construction and main-
tenance of U. S. Highway 62., commonly known and designated as the Brownfield
Highway and Project No. 380.1-13, and the value and total damages to the owners
for the fee simple title to said land have been appraised in the amount of $ 060: 00
and the Commission finds said amount to be fair and equitable; NOW THEREFORE
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT, the fee simple title to the following described land situated in Lubbo
County, Texas, be acquired by the City of Lubbock for and on behalf of the State
of Texas for the purpose of opening, constructing and maintaining in conjunction
with the State Highway Commission, said U.S. Highway 62;, commonly known and
designated as the Brownfield Highway and Project No. 380-1-13 as a designated --
part of the State Highway System,which land is more particularly described as
follows:
0. 048 of one acre in two strips of land more particularly described hereaft
as Parcels A and ,B, said strips being 1.0 feet in width and lying
parallel to and adjacent to the present southeast highway right of way
line and extending from the West to the East boundary line of the frontage
as now owned by Waddington, same being out of and a part of Block
% John W. Jarrett sub -division to the City of Lubbock, according to
a plat of said sub -division, being of record in Vol. 91, page 112, Deed
Records of Lubbock County, Texas, which tract was conveyed to J. K.
Waddington by deed dated September 6a, 1955, of record in Vol. 589,
page 367„ Deed Records of Lubbock County, Texas, which 0. 048 of
one acre is more particularly described by metes and bounds as follows:
PARCEL "A"
BEGINNING at the Northeast corner of said Waddington tract;
THENCE South 530561 West, 97. 6 feet along said present right
of way line to the Northeast corner of a certain tract of land conveyed
to E. R. Balch by deed of record in dols 55%,, page 537,, Deed Records
of Lubbock County, Texas;
THENCE South, 12. 4 feet along the East boundary line of said Balch
tract, to a point;
THENCE North 530561 East, 97.6 feet along a line parallel to and
10 feet Southeasterly from said right of way line to a point in the
East boundary lime of said Waddington tract;
THENCE North 12. 4 feet along said East bounda.r3r line to the PLACE
OF BEGINNING and contains 0. OZ2 of one acre.
PARCEL "B"
BEGINNING at the Northwest corner of said Waddington tract;
THENCE North 53056r East, 112 feet along said present right of way
line to the Northwest corner of said Balch tract;
THENCE south 360041 East, 10 feet along the 'q(i'est boundary line
of said Balch tract; to a point;
THENCE South 530561 West, 116.9 feet along a line parallel to and
10 feet Southeasterly from the said present right of way line, to a
point in the Fest boundary line of said Waddington tract, being also
the East boundary line of the.Lamb tract in said Block 5
THENCE Northwesterly 11. 9 feet along said West boundary line to
the PLACE OF BEGINNING and contains 0.026 of one acre.
THAT the owners of said land be offered, through the Right of Way De* -W
partment, the .amount appraised as the value and total damages for the fee simple
title and acquisition of said land for the purposes herein stated, for the use and
benefit of the City of Lubbock and State of Texas, and unless accepted forthwith
the City Attorney is hereby authorized and instructed to institute condemnation
proceedings to acquire the fee simple title to said land as hereinabove described,
for highway purposes.
