HomeMy WebLinkAboutResolution - 2021-R0192 - MOUs with Lamb Co., Family Support, Cenikor, and Hub City Outreach 5.25.21Resolution No. 2021-R0192 Item No. 6.15 May 25, 2021 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock four Memorandums of Understanding ("MOU") by and between the City of Lubbock acting by and through the City of Lubbock Health Department and Lamb County LEAF, Hooked on Hope; Family Support Services of Amarillo; Cenikor Foundation; and Hub City Outreach Center for participation in an integrated collaborative effort to meet the specific needs of the priority population, including serving as an essential link between prevention, intervention and treatment service, information and resources within Region 1, and related documents. Said MOUs are attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Passed by the City Council on May 25, 202 DANIEL M. AGENCIES: City of Lubbock Health Department 80618th Street Lubbock, TX 79401 Lamb County LEAF, Hooked on Hope 232 Phelps Littlefield, TX 79339 II. STATEMENT OF SERVICES TO BE PERFORMED: The parties hereto, agree by execution of this Memorandum of Understanding to participate in an integrated collaborative effort to meet the specific needs of the priority population, including serving as an essential link between prevention, intervention and treatment services, information and resources within Region 1. We the undersigned have agreed that we shall work together through a cooperative effort. This collaboration is not an offer of employment and does not include any additional funding. III. OBLIGATIONS OF THE CITY OF LUBBOCK HEALTH DEPARTMENT: To maintain and serve as the primary resource for substance use and related behavioral health data for the region. b. To coordinate the required prevention strategies across all substance abuse prevention grantees to ensure compliance with state regulations. c. To strengthen compliance with existing laws on the sale of tobacco and nicotine products to minors through education and monitoring activities. d. To increase awareness of the community regarding substance use and misuse through the dissemination of information across a wide variety of media outlets and distribution networks. e. To build the prevention workforce capacity through technical support and coordination of prevention trainings. IV. OBLIGATIONS OF YOUTH PREVENTION COALITIONS: a. Disseminate information on substance use disorders, wellness and health to youth and adults through presentations, social media, written materials and other forms of communication. b. Facilitate and coordinate positive activities to assist in gaining new skills and a sense of belonging and relationship building with their peers, family and community. c. Coordinate access to appropriate services and programs as needed. d. Increase community awareness about substance use disorders and build partnerships to reduce use. V. TERM OF AGREEMENT: This agreement is to begin September 1, 2020 and shall terminate August 31, 2021. This MOU may be extended for successive twelve (12) month terms by written agreement of the parties. This MOU may be terminated by any party upon 30 days written notice to the other party. THE UNDERSIGNED AGENCIES do hereby certify that, (1) the services specified above are necessary and essential for activities that are properly within the statutory functions and programs of the effected agencies and (2) the proposed arrangements serve the interest of efficient and economical administration. THE CITY OF LUBBOCK HEALTH DEPARTMENT AND IT'S AGENTS further certify that it has the authority to enter into this agreement for the above services under the provisions of Chapter 534 of the Texas Health & Safety Code Ann., as amended. Non -Arbitration: The City reserves the right to exercise any right or remedy available to it by law, contract, equity, or otherwise, including without limitation, the right to seek any and all forms of relief in a court of competent jurisdiction. Further, the City shall not be subject to any arbitration process prior to exercising its unrestricted right to seek judicial remedy. The remedies set forth herein are cumulative and not exclusive, and may be exercised concurrently. To the extent of any conflict between this provision and another provision in, or related to, this document, this provision shall control. Nonappropriation: All funds for payment by the City under this contract are subject to the availability of an annual appropriation for this purpose by the City. In the event of nonappropriation of funds by the City Council of the City of Lubbock for the goods or services provided under the contract, the City will terminate the contract, without termination charge or other liability, on the last day of the then -current fiscal year or when the appropriation made for the then -current year for the goods or services covered by this contract is spent, whichever event occurs first. If at any time funds are not appropriated for the continuance of this contract, cancellation shall be accepted by the Seller on thirty (30) days prior written notice, but failure to give such notice shall be of no effect and the City shall not be obligated under this contract beyond the date of termination. SB2S2: SB 252 prohibits the City from entering into a contract with a vendor that is identified by The Comptroller as a company known to have contracts with or provide supplies or service with Iran, Sudan or a foreign terrorist organization. HB 89: The Contractor warrants that it complies with Chapter 2270, Subtitle F, Title 10 of the Texas Government Code by verifying that: (1) The Contractor does not boycott Israel; and (2) The Contractor will not boycott Israel during the term of the Agreement.
