HomeMy WebLinkAboutResolution - 041163E - Joint Paving Release - Pioneer Pavers - Sub-Unit 14 Of Paving Unit #2077 - 04/11/19634L:lkm --_ RESOLUTION oq I 14 WHEREAS, the City Commission of the City of Lubbock has found that the West 60 feet of Lot 12, Block 9 Robert Neill Heights Addition to the City of Lubbo designated in paving ordinance No . 3788 as Paving Unit 207714 does not abutt the improvement to be constructed as to be described in said ordinance and is not subject to any paving assessment lien; and, WHEREAS any cloud on the title of the West 60 feet of said Lot 12 created by such paving ordinance should be removed; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City a joint wing release with Pioneer Pavers, Inc., covering Subunit No. 14 of Paving Unit No. 2077 as found in Ordinance No. 3788 recorded in Volume 888, Page 89 of the Deed Records of Lubbock Count Texas. A copy of said Release is attached hereto and made a part of this Resolution; Passed by the City Commission this llthday of April , 1963. STRONG, May , --------- F ov �,t►orneY Y JOINT PAVING RELEASE THE STATE OF TEXAS I COUNTY OF LUBBOCK Z WHEREAS, on April 4, 1962 the City of Lubbock passed Ordinance No. 3788, recorded in Volume 683, Frage 89 of the Deed Records of Lubbock County, Texas said ordinance containing a notice of Improve-ments and, apportionment of costs of such irnprove t -rents by assessing liens upon properties abutting such improvennents, and in said ordinance there was inc!-,;--,d paving assoss,- ants for Paving Sub -unit 14 of Paving 'snit No. 2077; and, WHEREAS, tho said F-'a,,dng Sub -unit was applicable to Lot 12, Block 9 Robert Neill Heights Addition in the City of Lubbock and the Wast 60 feet of said Lot 12, Block 9 was at the tine said ordinance •was passed under different ownership from the .East 60 feet of said Lot 1.2, wfaclo Fast CO feet of said Lot 12 will abutt the said improvements and will be subject to said lien; and, WHEREAS, the Fest 60 feet of Lot 12, Block 9 Robert Neill Heighte Addition was never subject to said lien although shown to be hn the Deed Records of Lubbock County, Texas; and, WHEREAS, the said ordinance as recorded in said Deed Records constitutes a cloud uroon the title of the West 62 feet of said Lot ??, NOW THEREFORE: KNOW ALL MEN BY TI.3'.ES.E PRESENTS: THAT, in consideration of the prernises the City of Lubbock, acting by and through its officers heretofore duly authorized. and Pioneer Pavers, Inc. , contractor do hereby RELEASE. RELINQUISH, and FOREVER QUIT CLAIM and by these presents have RELEASED.
