Paul Newman Et Al - Section 6 And 28 Block E2 - 10/27/1960io2 1e4) F RESOLUTION WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance of that part of the State Highway system, which has heretofore been designated as Loop 289 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said "Loop 289" situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS J. Paul Newman, Prudential Insurance Company, and Pioneer Natural Gas Company awn or have some.character interest in land needed for the location, construc- tion and maintenance of said Loop 289, and the value and total damages to the owners for the fee simple title to said land have been appraised in the amount of $ 1.895.00 and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said "Loop 289" as a designated part of the State Highway System, which land is more particularly described as follows: A parcel of land out of a certain tract of land in Section 6 and 28, Block E-2, conveyed to J. Paul Newman by deed dated 1 June 144, and recorded in vol. 289, page 512 of the deed records of Lubbock County, Texas, and being more particularly described as follows: BEGINNING at the Northwest corner of said tract, said point being 660 feet North of the Southeast corner of said Section 6; THENCE southerly 78.4 feet along the West boundary line of said Section 6, to a point; THENCE N 89051' E, 45.0 feet to a point; THENCE S 57053' E, 259.4 feet to a point; THENCE in a Southeasterly direction along a circular curve to the right, the center of the curve being S 54052' w, 1146.28 feet from the beginning of the curve, a distance of 300.0 feet to a point; THENCE S 20008' E, 1625.3 feet along a line parallel to and 150 feet westerly from the centerline of a proposed freeway as established in the field by the Texas Highway Department to a point in the South boundary line of said Newman tract; THENCE easterly 319.5 feet along said South boundary line to a point; THENCE N 20008' Wl, 1525.1 feet along a line parallel to and 150 feet easterly from said centerline to a point; THE14CE in a northwesterly direction along a circular curve to the right, the center of the curve being N 69052' E, 1146.28 feet from the beginning of the curve, a distance of 440.0 feet to a point; THENCE N 10521 E, 168.3 feet to a point in the North boundary line of said Newman tract; THENCE S 89445' W, at 315.3 feet cross said centerline, in all 727.7 feet along; said North boundary line to the place of beginning and contains 16.758 acres. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instru ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
