WHEREAS, the City of Lubbock and the State of Texas, by and through
the State Highway Commission, have entered into a contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the State
Highway system, which has heretofore been designated as Loop 289 by the State
Highway Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation
of the City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in order
to make certain highway -improvements in connection with said "Loop 289"
situated in and adjacent to the City of Lubbock and to the end that this
purpose be accomplished, the necessity of which is hereby confirmed by the
City Commission of the City of Lubbock, it is necessary that fee simple title
to the land hereinafter described be acquired by the City of Lubbock in
fulfillment and satisfaction of its contractual obligations to the State of
Texas; and,
WHETS Docia Brown and Estate of Lawrence E. Brown
own or have some character interest in land needed for the location, construc-
tion and maintenance of said Loop 289, and the value and total damages to the
owners for the fee simple title to said land have been appraised in the amount
of $90, Doo - no and the Commis s ion finds said amount to be fair
and equitable; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated in
Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf
of the State of Texas for the purpose of opening, constructing and maintaining
in conjunction with the State Highway Commission, said "Loop 289" as a
designated part of the State Highway System, which land is more particularly
described as follows:
29.102 acres of land in two parcels, same being out of and a part of the Nort
west Y of Section 59 Block E,.which Northwest 14 was conveyed to Mrs. Docia
Brown by deed dated 20 Oct.131, of record in vol. 169, page 463, Deed Records
of Lubbock County, Texas, which 29.102 acres of land is more particularly des
cribed by metes and bounds as follows:
PARCEL "A"
BEGINNING at the point of intersection of the present West rightof-way line
and the North boundary line of said Section 5;
THENCE S 0x04' E., 101.5 feet along said West right-of-way line to a point;
THENCE S 0011' E, 742.7 feet along said West right-of-way line, to a point;
THENCE N 0052' w, 844.2 feet,to a point in the North boundary line of said
Section 5;
THENCE East, 10.0 feet along said North boundary line to the place of begin-
ning and contains 0.097 acres.
PARCEL "B"
BE�$NG at a point in the West boundary line of said Section 5, said point
being 1658.5 feet South of the Northwest corner of said section;
THENCE N 89°57' E, 1903.4 feet along a line parallel to and 150.0 feet North
of the centerline of a proposed freeway as established in the field by the
Texas Highway Department, to the beginning of a circular curve to the left;
THENCE in a northeasterly direction alonj saia curve, zne center oz saia curve
being N 0°031 E, 215.0 feet from the beginning of the curve, a distance of

THENCE N 16°40' t, 199.9 feet to the beginning of a circular curveto the right
THENCE in a northeasterly direction along said curve, the center of the curve
- being S 73°20' E, 289.0 feet from the beginning of the curve, a distance of
168.2 feet, to a point;
THENCE N 49°50' E, 330.3 feet to the beginning of a circular curve to the left
THENCE in a northeasterly direction along said circular curve, the center of
the curve being N 40010' W,215.0 feet from the beginning of the curve,a dis-
tance of 144.8 feet,to a point in the present West right-of-way line of a
highway;
THENCE S 0011' A757.3 feet along said present right-of-way line to an angle
point;
THENCE S 5°32' W, 100.5 feet along said present right-of-way line to an angle
point
THENCE S 0011' A 934.8 feet along said.,West right-of-way line to a point in
f the South boundary line of said Northwest Y,,,;
THENCE westerly, 23.8 feet along said South boundary line, to a point on a
curve to the left;
THENCE in a northwesterly direction along said circular curve, the center of
said curve being S 54°21' W, 215.0 feet from the beginning of this call, a
1 distance of 69.48 feet to a point;
THENCE N 54010' W,2463 feet,to a point on a circular curve,to the right;
THENCE in a northwesterly direction along said curve, the center of the curve
+ being N 35°50' E, 289.0 feet from the beginning of the curve, a distance of
175.9 feet, to a point;
THENCE N 19017' W, 209.7 feet to the beginning of a circular curve to the left
THENCE in a northwesterly direction along said curve, the center of said
curve being S 70°43' W, 215.0 feet from the beginning of the curve, a dis-
tance of 265.5 feet, to a point;
THENCE S 89*57' W, 1928.4 feet along a line parallel to and 150.0 feet South
of the said centerline, to a point in the West boundary line of said Srtion 5
THENCE northerly, 300.0 feet along the said West boundary line to the place
of beginning and contains 29.005 acres.
THAT the owners of said land be offered, through the Right of Way
Department, the amount -appraised as the value and total damages for the fee
simple title and acquisition'of said land for the purposes herein stated,
for the use and benefit of the City of Lubbock and State of Texas, and
unless accepted forthwith the City Attorney is hereby authorized and instruc
ted to institute condemnation proceedings to acquire the fee simple title
to said land as hereinabove described for highway purposes.
