Lowrey, Sr. - Lowrey Subdivision - 12/08/1960RE SOLUT ION 12b1&c) [-- WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance of that part of the State Highway system, which has heretofore been designated as Loop 289 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said "Loop 289" situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS R. H. Lowrey, Sr. and7Zegma Lowrey own or have some character interest in land needed for the location, construc- tion and maintenance of said Loop 289, and the value and total damages to the owners for the fee simple title to said land have been appraised in the amount of $ 133,478.00 and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to.the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State highway Commission, said "Loop 289" as a designated part of the State Highway System, which land is more particularly described as follows: Being a tract of land out of Tract 2 of Lowrey Subdivision of Sections 359 36, 37, and 38, Block AK, and Section 28, Block E-2 and being more particularly described as follows: BEGINNING at the point of intersection of the South boundary line of said Section 28 and the West right-of-way line of a Farm -to -Market road, said point being also 60 feet westerly from the Southeast corner of said Section 28; THENCE westerly 2.2 feet along the said South boundary line of Section 28 to a point; THENCE in a northwesterly direction along a circular curve to the left, the center of the curve being S 81042' W, 215.0 feet from the beginning of this call, a distance of 217.7 feet to a point; THENCE N 660201 W, 598.1 feet to a point; THENCE N 72003' Ws 1215.6 feet to a point; THENCE in a northwesterly direction along a circular curve to the right, the center of the curve being N i?°57' E , 2980.93 feet from the beginning of thi curve, a distance of 335.0 feet to a point; THENCE N 60°55' W, 126.0 feet to a point in the East boundary line of a cer- tain 40 acre tract out of the Southwest corner of said Tract 2; THENCE N 0001' W, 358.5 feet along the said East boundary line to the North - .east corner of said 40 acre tract; THENCE S 89059' W, 672.4 feet along the North boundary line of said 40 acre tract to a point; THENCE in a northwesterly direction along a circular curve to the left, the center of the curve being S 23°151 W, 2758.93 feet from the beginning of thi call, a distance of 676.2 feet to a point in the West boundary line of said Tract 2; THENCE North 1131.5 feet along said West boundary line to the Northwest corn of said Tract 2; THENCE East 265.1 feet along the North boundary line of said Tract 2 to a po THENCE in a southeasterly direction along a circular curve to the left, the center of said curve being N 52045' E, 2748.93 feet from the beginning of th. call, a distance of 895.29 feet, to a point; THENCE S 55055' E, 1740.2 feet to a point; THENCE in a southeasterly direction along a circular curve to the left, the center of the curve being N 34°05' E, 3703,83 feet from the beginning of the curve, a distance of 560.5 feet to a point; THENCE S 75024, E, 484.3 feet to a point; THENCE in a northeasterly direction along a circular curve to the left, the center of the curve being N 140361 E, 215.0 feet from the beginning of the curve, a distance of 392.8 feet to a point in the said nest boundary line of a Farm -to -Market road; THENCE S 0°041 E, 861.2 feet along said West right-of-way line to the place of beginning and contains 53.391 acres. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instruc, ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
