RFSOLUTICN
WHEREAS, the rapid growth and development of this portion of the City has
caused a need to remove surface drainage at the location of Avenue Q and 41st
Street, and
WHEREAS, the developers of Lot 1 Block -16 Southport Addition has agreed to
construct a storm sewer., at no cost to the City, -County or State, and
,J WHEREAS, the City Ehgineering Department has designed an adequate storm
sewer to relieve the surface drainage;
BE IT RESOLVED BY THE CITY COMaSSICK OF THE CITY CF LUBBOCK.,
~' Section I. That the State Highway Department is here by requested to
consider the return of the drainage strip across said property to the present
owners so that they may develope the area.
Section 2. The City Engineer is authorized and directed to duly inspect
said construction on said storm sewer and to require strict compliance with the
approved plans and specifications, and upon completion that the City Engineer
be and he is hereby authorized to give final approval and acceptance of said
�Lmprovements and direct payment to the contractor by the property owners.
Section 3. This authority is conditioned that the owners of the abutting
property and the contractor will pay for all material and labor and cost
incidental to such construction, indemnify the City of Lubbock, County of Lubbo<
and State of Texas against any cost, claims or damages of every nature pertainix
thereto, and that all improvements designated herein shall be a permanent part
of said drainage and the property of the City of Lubbock, without any liability
whatsoever.
On Motion of Commissioner Thompson , seconded by
Commissioner I O'Mara 0 the foregoing resolution was
unanimously passed by the City Commission this 23 day of Eovemb/err,, 1960.
