HomeMy WebLinkAboutResolution - 071360I - Land Acquisition - CCC Corporation Et Al - Section 4 Block E2 - 07/13/1960cn t; Y RESOLUTION WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered and authorised by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, ganstiviption and maintenance of that part of the State Highway system, which has heretofore been designated as Loop 289 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the'State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said "Loop 289" situated in ayid adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; And, WISES CCC Corporation, Clawson Building Company, Southwestern Bell Telephone Company, and Pioneer Natural Gas Company. own or b4y@ some character interest in land needed for the location, construc- tion and maintenance of said Loop 289, and the value and total damages to the owners for tib fee simple title to said land have been appraised in the amount of $ 8.000.00 end the Commission finds said amount to be fair and equitable; NOW THEREPME; BE IT RESOLVED BY THE CITY COP'Q'IISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said "Loop 289" as a designated part of the State Highway System, which land is more particularly described as follows: A parcel of land out of the northeast one-quarter of Section 4, Block E-2, .conveyed to CCC Corporation by deed dated 4 Dec. '58, and recorded in vol. 73 page 179 of the deed records of Lubbock County, Texas, and being more parti- cularly described as follows: BEGINNING at the point of intersection of the went boundary line of said northeast one-quarter and the south right-of-way line -of a farm -to -market road, said point being 60 feet south and 2637.5 feet east bf the northwest corner of said Section 4; THENCE easterly along said ' right--of-way line 735.6 feet to a point; THENCE in a southwesterly direction left, the center of the curve being S 0°Ol' W, along a,circular curve to the 215 feet from the beginning of the curve, a distance of 117.3 feet to a point THENCE S`58°46' W, 628.3 feet to a point; THENCE S 53°03' W, 108.7 feet along a line parallel to and 150 feet southeasterly from the centerline of a propos freeway as.established in the field by the Texas Highway Department, to a point in the west boundary line; THENCE northerly along said west boundary "' line 422.3feet to the place of beginning and contains 3.196 acres. n' ti� .A n THAT the owners of said land be offered, through the Right .of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instruc ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
