Hancock Et Al - Section 15 Block A - 03/23/1961RESOLUTION ote9ue( WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway -Commission, have entered into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance of that part of the State Highway system, which has heretofore been designated as Loop 289 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and) WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said "Loop 289" situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS J. E. Hancock and Security Life & Accident Company own or have some character interest in land needed for the location, construc- tion and maintenance of said Loop 289, and the value and total damages to the ,., owners for the fee simple title to said land have been appraised in the amount of $81. 858.00 and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for -the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said "Loop 289" as a designated part of the State Highway System, which land is more particularly described as follows: 8.507 acres of land, being out of and a part of that certain tract in the �I North '3� of -Section 159 Block A, which tract was conveyed to J.E. Hancock by deed dated 24 Apna.'.51, of record in vol. 443, page 1509 Deed Records of Lubbock.County, Texas, which 8.507 acres of land is more particularly described by metes and bounds as follows: BEGINNING at the northern most corner of said tract, said point being the point of the beginning of the said tract, said point being also 1254.88 (I feet South and 3666.4 feet East of the Northwest corner of said section; THENCE S 75°11' E, 573.8 feet to the Northeast corner of said tract; THENCE S 32022130+' W, 377.9 feet along the Southeast boundary line of said tract, to a point; THENCE N 77*16, W, 382.2 feet, to a point, said point being 195.0 feet Southwesterly from the centerline of a proposed freeway as estab- lished in the field by the Texas Highway Department; THENCE N 70°46' W, 161.1 feet, to a point; i THENCE in a Southwesterly direction along a circular curve to the left, the center of the curve being S 19014, W, 215.0 feet from the beginning of the curve, a distance of 261.1 feet, to a point; THENCE S 39x40' w, 839.0 feet, to a point; THENCE S 37°37' W, 59.1 feet, to a point in the South property line of said Hancock tract; THENCE N 89057' W, 39.3 feet along said South property line to the Southwest corner of said Hancock tract; THENCE N 23°46v E, 298.2 feet along the Western boundary line of said tract, to a point; THENCE N 30m30t E, 229.7 feet continuing along said Western boundary to the beginning of a curve; THENCE in a Northeasterly direction along said circular curve, the center of the curve being S 59°30' E, 5654.65 feet from the beginning of the curve, a distance of 493.5 feet to the Northwest corner of -said tract; THENCE S 75011' E, 310.4 feet to an interior corner of said tract; THENCE N 38038, E, 357.0 feet to the place of beginning. Description continued on attached sheet. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instru ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes. Easement 0.317 of one acre of land, being out of and a part of that certain tract in the North l/ of Section 15, Block A, which tract was conveyed to J. E. Hancock by deed dated 24 April 151, of record in vol. 443, page 1543 Deed Records of Lubbock Cou#ty, Texas, which 0.317 of one acre is more particularly described by metes and bounds as follows: A strip of land 40.0 feet in width, lying 20.0 feet Northerly and 20.0 feet Southerly from the following described centerline:- BEGINNING enterline: BEGINNING at a point in the proposed Easterly right-of-way line of a highway, said.point being 141.3 feet right of engineer's station 305+75: said point being:.also 2148.3 feet South and 2835.6 feet East of the North- west corner of said section; THENCE S 56°ig' E, 345.3 feet, to a point in the South boundary line of said Hancock tract, said point being S 89057' E, a distance of 36.0 feet from the Northeast corner of a tract of land conveyed to Ed Halcomb by deed dated.15 January 1952, of record in Volume 454, Page 341, Deed Records of Lubbock County, Texas.
