RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to accept and
execute for and on behalf of the City of Lubbock, four Garbage Service Collection Easements
in connection with certain real property located in Lots 5 through 8, Villas of Country Place
Addition to the City of Lubbock, Lubbock County, Texas, by and between the City of Lubbock
and William Norwood, Elizabeth Hodge, Maxine Ballard, and Erin Lemon, and all related
documents. Said Easements are attached hereto and incorporated in this resolution as if fully
set forth herein and shall be included in the minutes of the City Council.

GARBAGE SERVICE COLLECTION EASEMENT
THE STATE OF TEXAS §
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK §
THAT William R. Norwood, herein called "GRANTOR[S]", for and in
consideration of the sum of TEN AND NO/100 DOLLARS ($10.00) to GRANTOR[S] in
hand paid by the CITY OF LUBBOCK, a Home Rule Municipal Corporation of Lubbock
County, Texas the receipt and sufficiency of which is hereby acknowledged and confessed,
and for the further good and valuable consideration in benefits accruing and to accrue to the
remainder of GRANTOR'S property, has by these presents GRANTED, BARGAINED,
SOLD and CONVEYED and by these presents does GRANT, BARGAIN, SELL and
CONVEY unto the CITY OF LUBBOCK, its legal representatives, successors and assigns,
for the use of the CITY OF LUBBOCK as a perpetual and permanent garbage/solid waste
collection easement, the free and uninterrupted use, liberty of passage in, on, over, upon,
along, under and across all that property lying and being situated in the County of Lubbock,
State of Texas, and being more particularly described as follows, to -wit:
The East twenty feet (20') of Lot 5, Villas of Country Place, an addition to the City of
Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed
thereof recorded in Volume 4483, Page 268 of the Real Property Records of Lubbock
County, Texas
together with the rights of ingress, egress and regress at any and all times to accomplish the
following purposes: allowing solid waste and garbage collection trucks to collect garbage and
solid waste. Which easement includes at all times and seasons the right of ingress, egress
and regress of motor vehicles and personnel engaged either in such construction, repair or the
reading of meters, or collecting garbage and solid waste including the placement of garbage
containers in convenient places in such easement as necessary for the collection of garbage
and solid waste and as necessary to protect the public health. Said property above described
is not used, claimed or occupied as a business.
In order to assure the said CITY OF LUBBOCK, its successors and assigns of
continuing access and enjoyment of said easement, the said GRANTOR[S] does hereby
expressly agree not to erect, build or otherwise allow to be constructed any building or like
permanent structure over the said property heretofore described; and should such building or
structure be erected, it is understood that the said CITY OF LUBBOCK shall have the right
to remove said building or structure from the premises and GRANTOR[S] shall be solely
responsible for the cost of such removal.
I.
The CITY OF LUBBOCK covenants to come onto the aforementioned property
owned by the GRANTOR[S] periodically for the purpose of sanitation, refuse, solid waste, or
garbage collection services (including but not limited to solid waste, recyclables, brush or
bulky items).
II.
GRANTOR[S] covenants to confine refuse, solid waste, or garbage (including but not
limited to solid waste, recyclables, brush or bulky items) to an area of the aforementioned
property, and in the manner specified by the CITY OF LUBBOCK.
GRANTOR[S] for and in consideration of the services to be provided by the CITY
OF LUBBOCK as set forth in this easement, hereby grants permission to the CITY OF
LUBBOCK to come onto the aforementioned property for the purpose of sanitation, refuse,
solid waste, or garbage collection services, (including but not limited to solid waste,
recyclables, brush or bulky items) and said GRANTORS] hereby covenants for itself,
successors and assigns, to hold harmless, indemnify and release from liability the CITY OF
LUBBOCK, its employees, servants, contractors, agents or assigns, for any damages to the
private access drive surface caused by CITY OF LUBBOCK vehicles or to any trees,
structures, buildings, improvements or personal property that is situated within the easement
and is on or adjacent to the access drive in such a manner as to constitute an obstruction to
the CITY OF LUBBOCK in carrying out the services described herein.
IV.
The parties hereby agree that the CITY OF LUBBOCK has no affirmative duty to
pick up garbage, tree limbs, brush, bulky items and/or solid waste on private property, and
grants this easement solely for the benefit of the GRANTOR[S] and the CITY OF
LUBBOCK thereby reserves the right to terminate, abandon, and close this easement at will.
TO HAVE AND TO HOLD the above described premises together with all and
singular the rights and appurtenances thereto in anywise belonging perpetually unto the
CITY OF LUBBOCK, its successors and assigns for so long as the CITY OF LUBBCOK
uses the same for the purposes herein granted.
