Quirt Avenue in the City of Lubbock, it is necessary to open, extend, straighten and widen said Quirt Avenue ; and, WHEREAS, toyaccomplish this purpose, it is necessary to acquire for street right of way purposes the fee simple title of the land hereafter described; and, WHEREAS, Earl Stalnaker and wife Mildred, and Great National Life Insurance, and the Hilton Supply Co, U -Haul, Sears Robuck, and Mrs. W. B. Price. - own said land, and the value and total damages to the owner for the fee simpl title to said land have been appraised in the amount of S 40,420.00 and the Commission finds said amount to be fair and equitable; NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in th City of Lubbock, Lubbock County, Texas, to acquired by the City of Lubbock fo the purpose of opening, extending,, straightening and widening the public street known and designated as widening of Gtreet known ap Quirt Avenue. which land is more particularly described as follows: Two (2) parcels of land out of the Stalnaker Subdivision in the Northwest 1/4 of Section 4, Block 0, Lubboc County, Texas; more .fully described as follows: TRACT I. BEGINNING at the SW corner of Lot 2, Stalneker Subdivipion; THENCE North 140 feet to the VW cornef ofisatd.'-.Lot 2; THENCE Easterly 30 feet to a. point; THENCE South parallel to and 30 feet East of the West line of said Lot 2, 140 feet to a point in the South line of said Lot 2; THENCE West 30 feet to the POINT OF BEGINNING. TRACT II. BEGINNING at the SW corner of Lot 1, Stalnaker pubdiviston; THENCE North 248 feet to a point; THENCE Easterly 30 feet to a point; THENCE South parallel to and 30 feet East of the West line of said Lot 1, 248 feet to a point; THENCE West 30 feet to the POINT OF BEGINNING. THAT the owner(s) of said land be offered, through the Right of Way Dep went, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the u and benefit of the City of Lubbock, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation pro- ceedings for and on behalf of the City of Lubbock to acquire the fee simple title to said land as hereinabove described for street purposes.
