RESOLUTION
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
I
THAT the Mayor of the City of Lubbock be and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Warranty Deed to
J. W. Wright conveying the land described in the attached conveyance which shall
be spread upon the minutes of the Commission and as spread upon the minutes of
this Commission shall constitute and be a part of this resolution as if fully copied
herein in detail.
Passed by the City Commission :this 27th day of June , 1963.

KNOW ALL MEN BY THESE PRESENTS:
"COUNTY OF LUBBOCK I
THAT the City of Lubbock, a Home Rule Municipal Corporation, of the
County of Lubbock, State of Texas, acting by and through its Mayor, heretofore
duly, authorised for and in consideration of the sum of SIX HUNDRED SIXTY-ONE
AND 25/100 DOLLARS {$661.25} cash to it in hand paid by J. W. Wright, of
Lubbock County, Texas, the receipt of which is hereby acknowledged, and the
further sum of ONE 'THOUSAND NINE HUNDRED EIGHTY-THREE AND 75/100
DOLLARS ($1.9$3.75) secured to be paid and evidenced by grantee's Promissory
Vendor's Lien Note, of even date herewith, which note is further described as
follows:
An Installment V'endor's Lien. Note in the amount of $1, 983. 75, dated
Julys 1963, payable to the City of Lubbock, Texas in three
(3) annual installments of $661.25 each, together with Interest of six
per cent (6%) per annum; with the first payment being due on July
, 1964, and an equal amount being payable on July
of each year thereafter until the principal and interest is paid in
full; said Vendor's Dien Note being further secured by a 'Beed of
Trust given to Bill J. McGinnis,. Trustee, for the benefit of the
City of Lubbock.
Has granted, sold and conveyed, and by these presents do grant, sell and
convey unto the said grantee, J. W. Wright, of Lubbock County, Texas, all that
certain parcel of land:
A parcel of land out of Section 19, Block A, Lubbock County, Texas,
more fully described by metes and bounds as follows:
BEGINNING at a point 198.30 feet North and 25.0 feet West of the
original Southeast corner of Block 53, Roberts and McWhorter Addition
to the City of Lubbock as said original plat appears in Vol. 18 pages
176 and 177, Lubbock County Deed Records~
'H NCE North parallel and 25.0 feet West of the original East kine
of ,.said Blo6k 53 a distance of 175.1 feet to a point;
THENCE West a distance of 38.58 feet to a points
THENCE North 860 061 West a distance of 10.0 feet to a point in
the Southeast R. 0. W. line of the Santa Fe Railway Co.;
'WHENCE Mouth 530 54' West along said R, O. W. line a distance of
310.88 feet to the intersection of said R.0. W. line wvith the original
West line of said Block 53, said point being 198.30 feet North of
the original SW earner of said Block 53s
THENCE east a distance of 295.60 feet.to the POINT OF BEGINNING.
SAVE AND EXCEPT from the above described trail: of land there
is expressly retained herein, across, in and over the following
described tract of lend to -wit:
BEGINNING at a point $73.40 feet North and 63.53 Feet West of
the original SE corner of Block 63, Roberts and McWhorter Addition
to the City of Lubbock as said original plat appears in Vol. 18,
pages 176 ,and 197 Lubbock County Deed Records;
THENCE North 360 06' West a distance of 10.0 feet to a point in
the Southeast R.0, W. line of the Santa Fe Railway Co.;
THENCE South 630 fro' West along the P.O. W. tine of said Railway
Co. a distance of 100.0 feet to a point;
'T'HENCE South 360 06' East a distance of 10.0 feet to a point;
THENCE North 630 54' East parallel to and 10 feet distant from
said R. 4. W. line a distance of 100, 0 feet to the POINT OF BEGINNING,
a perpetual and permanent easement in, over, above and across said
lands which includes but does not limit to the right b construct, re-
construct,, repair and perpetually maintain any and all types of water,
sewer and gas lines, telephone and telegraph and electric transmission
lines whether now constructed on, over or across said tend hereinabove
described or to be constructed in the future, together with the rights
of ingress, egress and regress for such purposes.
T4 HAVE AND TO HOLD the above described property and premises, to-
gether with all and singular the rights and ,appurtenances thereto in anywise
belonging, unto the said grantee, his heirs and assigns forever; and I do hereby
bind the City of Lubbock and its successors to warrant and forever defend all
and singular said premises unto the said grantee, his heirs and assigns, against
every person whomsoever lawfully claiming or to claim the same or any part
thereof.
But it is expressly stipulated and agreed that a V'endor's Lien and the
superior title are retained against the above described property and premises
until said note is fully and finally paid according to its face and tenor, effect
and reading, when this deed shall become absolute.
