City Commission of the City of Lubbock has heretofore determined and now finds that due to the continued growth in size and population of the City of Lubbock and the continued growth of construction of commercial and residentail areas on previously open land, it is necessary to establish an addition ,I public park in the City ofubbock; and � � I jWHEREAS, to accomplish this purpose, it is necessary to acquire for Park li purposes the fee simple title of the land hereinafter described; and, WHEREAS, CHARLES E„' HOBGOOD and his wife, MARTHA E HOBGOOD, ji owns said land, and the value and total damages to the owner for the fee simple 'i title to said land appear to in the amount of $10, 000.00 based on sales of land in II, the immediate area of said land, and the Commission finds said amount to be fair , and equitable; NOW THEREFORE,' BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in the City of Lubbock, Lubbock County, Texas, be acquired by the City of Lubbock for the purpose of establishing a public park, such land being more particularly described as follows: A five acre tract of land out of Section 5, Block B, Lubbock County, »- Texas, more fully described by metes and bounds as follows: 1 I l BEGINNING at a point in the North line of said Section 5, Block B, li said point being 1269.4 feet West of the Northeast corner of the said Section 5, Block B; 1 THENCE South a distance of 450.0 feet to a point; THENCE West a distance of 484.0 feet to a point; THENCE North a distance of 450.0 feet to a point, said point being in the North line of the said Section 5, Block B; THENCE East along the said North line a distance of 484.0 feet to the point of beginning and containing 5.0 acres. 9 THAT the owners of said land be offered, through the Right of Way Department the amount herein designated as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the Cit of Lubbock to acquire the fee simple title to said land as hereinabove City q P I, described forparkpurposes.
